今年3月初，绵竹市公安局网安大队在网络巡查中，发现一段名为“成都4P”的淫秽色情视频在网上火热传播。一时间“成都4P”成为各大搜索引擎热门关键词。此时网安大队收到了腾讯公司转来的绵竹籍网友关于“成都4P”的举报线索。
经过查询核实，发现绵竹新市公安派出所也接到了相同举报。

通过进一步侦查，民警很快确定发布这段淫秽视频的是一个网名叫“雪梨枪”的女主播，她也是这段视频中的2名女性表演者之一。随着调查的深入，“雪梨枪”的真实身份逐渐浮出水面，这个网络直播圈的“当红女主播”为林某，21岁，德阳中江县人，事发时暂住成都市区。
办案民警辗转多地，对案件展开深入调查。一名参与此案的民警介绍，“雪梨枪”不仅拥有近万名微博粉丝，而且从2015年底开始，她先后成为多个手机直播软件的热门女主播，拥有着4万余人的粉丝量，在圈内“名气”不小。
掌握了关键情况后，绵竹警方决定对林某某等涉案人员实施抓捕。5月4日晚8时许，德阳、绵竹两级警方组成的抓捕小组，在成都市金牛区某小区门口，将刚从阿联酋迪拜旅行回来的林某某和王某，以及前来迎接她们的李某等三人当场抓获。

林某交待，大学毕业后她在成都找了一份售货员的工作，但觉得太累又不挣钱，没干多久就辞职了。后来，跟着别人做起了微商，但收益很一般。2015年底前后，林某某开始以“雪梨枪”的网名，“专心致志”地做起了网络平台的女主播。
为了更快地聚集“人气”使自己成为“网红”，达到牟取暴利的目的，今年2月的一天，她伙同另外2男1女，在成都市区一处出租屋里录制了“成都4P”淫秽视频。
经查实，被告人林某以牟利为目的，利用互联网、移动通讯终端等制作、传播淫秽视频共计31部，注册会员达1100人以上，获利达七万五千余元，其行为已构成制造、传播淫秽物品牟利罪。
11月23日下午，绵竹市人民法院对该起案件进行了公开宣判。被告人林某犯制造、传播淫秽物品牟利罪，判处有期徒刑4年，并处罚金10万元；作案工具手机、电脑等予以没收。
据介绍，根据中国的司法解释，通过制作、传播淫秽物品牟利，金额达到1万元以上就构成了犯罪，处3年以下有期徒刑，数额达到5倍以上25倍以下，则处3——10年有期徒刑。另外，注册会员达到200人以上也构成了犯罪，即便没有谋取利益，只要传播面达到了200人以上也会构成犯罪。
