警方实地调查后发现，何某通过南通百盛教育咨询有限公司及QQ群，策划与“助考”机构人员合作，准备在当年9月进行的国家“一级建造师”执业资格考试中“大干一场”，大规模组织考试作弊活动。
其间，何某频繁流窜于国内多个省市，寻找国家“一级建造师”考试的考题来源，最终在湖北武汉与王某取得联系，商定向其购买考试试题。何某又与山东日照的周某、江苏苏州的陈某等人策划集体出资购买试题，还赴山东日照和周某等商量组织“枪手”答题一事。
数十个下线代理负责招生
每门考试收费最高数万元
考试作弊活动大多是通过下级代理“招生”，因此，何某掌握着数十个下线代理，其手下严某专门为该团伙研发和改装无线传输、手机APP软件、米粒耳机等作弊设备。
为考试作弊需要，何某还将网购所得的近200套米粒耳机和线圈，交由他人进行加工，找人开发出可将文字转化为语音播报的APP软件，使考生在作弊时可以收听由文字转化为语音播报的答案。
根据每个作弊考场的反作弊严密程度，何某设了不同的收费档次，每门从几千元到几万元不等，其中VIP考生要掏数万元。
2015年9月16日,南通警方抽调100余名警力组成8个抓捕组，分赴湖北、山东、安徽等地开展工作。专案组决定在“一级建造师”考试第三门科目开考后集中收网，9月20日8时45分，警方统一开展抓捕行动，抓获犯罪嫌疑人27名，涉案考生达500余名。
经江苏省人事考试中心、江苏省国家保密工作局鉴定，现场搜集到的证据与相关考试科目均具有同一性，且该试题、答案等在启用前为绝密级国家秘密。
法院审理认为，何某、王某等27名被告人组成“一条龙”团伙，以收买的方式非法获取属于绝密级国家秘密的国家“一级建造师”统一考试试题，并使用作弊的方法帮助考生通过考试，均已构成非法获取国家秘密罪，且该案27名被告人属共同犯罪，无论是直接获取试卷的被告人，还是答题人以及答案传输者，均在共同犯罪中扮演着特定的角色。根据各被告人的犯罪情节及认罪态度，法院遂作出上述一审判决。
组织百余考生作弊牟利

据该案承办法官曹彬介绍，《中华人民共和国保守国家秘密法》第十一条规定：国家秘密及其密级的具体范围，由国家保密行政管理部门分别会同外交、公安、国家安全和其他中央有关机关规定。
中共中央保密委员会办公室、国家保密局《关于进一步加强国家统一考试保密管理工作的通知》规定，由国家主管部门组织的国家教育、执(职)业资格、国家公务员录用和专业技术人员资格等国家统一考试的试题、答案和评分标准，在启用前均属于国家秘密。
同时,《中华人民共和国建筑法》第十四条规定，从事建筑活动的专业技术人员，应当依法取得相应的执业资格证书，并在执业资格证书许可的范围内从事建筑活动。
“本案中，国家‘一级建造师’考试作为专业技术人员资格的国家统一考试，其试题、答案和评分标准在启用前均属于国家秘密。”曹彬介绍说。
2015年11月1日起，《中华人民共和国刑法修正案(九)》开始生效，社会强烈呼吁的考试作弊首次被纳入刑法。据曹彬介绍，此次立法首要处罚的是组织作弊，而所谓组织作弊指的是通过招募、雇佣、强迫、引诱等手段，安排、策划他人通过不公正的手段获取考试成绩。对于这一行为，刑九规定的是处三年以下有期徒刑或者拘役，并处或者单处罚金；情节严重的，处三年以上七年以下有期徒刑，并处罚金。
本案中，被告人何某组织100余名考生通过非法获取国家秘密的方式参加国家“一级建造师”考试牟利，系共同犯罪中的主犯，且其曾因犯非法获取国家秘密罪被判处刑罚，依法应认定为情节严重。
