　　新京报讯 （记者李禹潼）西城区原副区长苏东被控在工程建设、子女上学等方面为他人提供帮助，多次收受钱款140万。新京报记者昨日获悉，法院经审理于近日作出判决，一审以受贿罪判处苏东有期徒刑4年，并处罚金人民币30万元。

　　记者注意到，向苏东行贿的徐某系苏东妻子就职单位的法人，140万的贿款中有100万是给苏东妻子的买房补贴，另40万打着资助苏东女儿留学的旗号。作为回报，苏东给教委递条子让徐某亲属的孩子违规入学，并让下属关照徐某的工程。

　　被控受贿140万 受审认罪

　　今年54岁的苏东是北京人，研究生文化，案发前任北京市西城区人民政府常务副区长。因涉嫌犯受贿罪，苏东于2016年4月5日被刑事拘留，同年4月19日被逮捕。

　　检方指控，苏东于2008年至2014年间，利用担任北京市西城区人民政府副区长、中共北京市西城区人民政府党组副书记、中共北京市西城区委员会委员的职务便利，接受北京天泰置业有限公司法定代表人徐某的请托，为上述公司在工程建设等方面提供帮助，为徐某亲友的孩子在违规上学等方面提供帮助，为此，多次收受徐某给予的钱款共计人民币140万元。

　　检方认为，苏东身为国家工作人员，利用职务上便利为他人谋取利益，非法收受他人财物，数额巨大，应以受贿罪追究其刑事责任。

　　此案开庭时，苏东对指控其犯罪的事实不持异议，当庭表示认罪悔罪。

　　法院认定受贿 苏东不上诉

　　案件审理时，辩护律师钱列阳为苏东做罪轻辩护，称苏东如实供述犯罪事实，积极退赃，认罪、认罚，且其职务行为客观上为西城区的改造和建设工程进行了协调和处理，该行为更多的是履行应尽的职责，权钱交易主观恶性较小，且没有造成任何损害结果，建议从轻处罚。

　　法院审理认为，苏东身为国家工作人员，利用职务便利，为他人谋取利益并收受他人给予的贿赂，其行为已构成受贿罪，且数额巨大，依法应予惩处。

　　苏东作为副区长，明知徐某给予其的钱款具有不正当性，徐某明确提出在工程建设过程中要求照顾后，积极完成请托，其行为明显具有为他人谋取违法利益的权钱交易的特性。

　　对辩护人所提苏东如实供述犯罪事实，积极退赃，认罪、认罚，建议从轻处罚的辩护意见成立，法院予以采纳。

　　综上，法院一审以苏东犯受贿罪，判处有期徒刑4年，并处罚金人民币30万元。扣押在案的人民币140万元予以没收，上缴国库。

　　判决后，苏东表示不上诉。

　　行贿人徐某证言显示，苏东的妻子王某在其担任法人的天泰置业公司任总经理助理，管财务工作。2008年7、8月，苏东向其提出，希望能与金融街集团的领导沟通一下，让其优惠购置集团开发的房产，徐某沟通后，以股东内部价让王某购入低价房。

　　苏东妻子王某称，当时家中有更换居住条件的想法，其在公司和徐某说起金融街集团开发的房屋，随后经徐某协调，王某以内部价购置房产。在银行人员到公司核实王某的贷款信息时，徐某将100万元转账到其名下账户里，作为购房补贴。

　　“苏东是西城区的副区长，我的公司在西城区经营，难免有需要苏东关照的地方。”徐某称，考虑到这些，才又额外给了购房补贴。

　　为行贿人亲属孩子上学“递条子”

　　除了购房补贴，在得知苏东和王某的女儿出国读书后，徐某自2012年到2015年每年给王某10万元资助孩子，其中前三年是直接现金赠予，第四年以助学金的名义从公司账面直接支钱。

　　徐某也从苏东那里获得回报。徐某称，2009年和2011年，其姐姐的孙子和外孙上小学，但户口均不在学区内，苏东给教委“递条子”后，两个孩子顺利进校就读。徐某坦言，“如果苏东不帮忙打招呼，两个孩子肯定不能入学。”

　　时任教委负责人田某证言证实，2009年前后，苏东曾给其写条子让解决户口不在学区的孩子上学问题。田某称，虽苏东不主管教委，但其是西城区比较重要的领导，教委的工作免不了涉及苏东分管的领域，他担心得罪苏东今后开展工作会碰到麻烦，所以苏东递来的条子田某一般都会尽量解决。

　　时任办事处主任的张某证言中提到，徐某的工程开工前，苏东曾前往视察，希望在场的建委、城管、派出所等部门都“给予配合”。后在徐某组织的饭局上，苏东再次强调有关部门配合工程。

　　张某说，工程开工后，因扰民、遗撒等问题，周围的居民和施工方产生矛盾，自己向上级汇报后被强调，既要维护好居民的利益，还要保障施工顺利进行，“苏东为这个工程打过招呼”。
