刷单者每月收商家会费268元
先看月销量，再看好评度，这是许多“剁手族”在网购前要做的“功课”。不过，这并非每次都靠谱——有些炒信公司为无良商家提供刷单服务，迷乱消费者的眼睛。
90后的杨某就是一个刷单的幕后操纵者。两年前的8月，他在杭州购买了一处工作室，雇用了三个员工，通过运营“傻推网”，干起了职业刷单的行当。记者了解到，杨某公司的利润来源一部分是手续费，按商家给刷手佣金的20%收取；一部分是会费，每月268元，每年1980元。高昂的费用带来不俗的收益：不到两年时间，5000多个商家与他们进行过交易，参与的刷手账户超7000多个；这个团伙共刷出流水资金2650万，杨某本人获利超40万，刷手合计获利173.5万。
不过，剧情在今年4月出现了反转。经过线上数据串并和线下实地排摸，“傻推网”的刷单行为被电商平台阿里巴巴识破，杨某“赚大钱”的梦就此破碎了。4月5日，该刷单窝点被公安局现场查处，执法人员当场收缴了这一网站的相关设备、账簿及企业资金流转财务单据。

刷单团伙虽然被抓了，可处罚力度却引发争议——据阿里介绍，在该组织约200万元的非法盈利面前，罚金却只有约10万元。处罚依据是《网络管理交易办法》等法律法规。《网络管理交易办法》规定，以虚构交易、删除不利评价等形式，为自己或他人提升商业信誉，应处以一万元以上二十万元以下的罚款、责令停止违法行为，没收违法所得，法人加入企业黑名单。

急需对炒信行为单独立法
炒信行为有多少危害？中国电子商务协会政策法律委员会副主任阿拉木斯向本报记者总结道：它使电商平台的交易秩序受到破坏、消费者受到蒙蔽，炒信商家也付出了本不该付出的成本，在炒信路上越陷越深。
那么，单靠目前的法律规定，能否对炒信行为起到威慑作用呢？广东金融学院法学所所长姚志伟接受本报记者采访时说：“就此案来说，200万非法盈利，10万罚金，明显达不到惩罚作用，反而可能对刷单者起到鼓励作用。”
针对炒信行为进行直接立法，是惩戒这一行为的重要手段。两位律师都指出，中国对炒信行为缺少直接的法律规定，应在这一领域进行单独立法。阿拉木斯表示，阿里将“傻推网”告上法庭，表现了企业只能通过民事诉讼手段来追究刷单网站责任的现状。但对炒信行为的制裁，不能单靠民事诉讼，而要靠法律的修订调整，或司法解释的出台。他举例说：“在经济处罚力度上，如果能按照违法所得的两倍或三倍来处罚，就有可能对这种行为实现毁灭性的打击。”
姚志伟还补充道，刷单不是电商平台的“专属”，打车软件等非电商平台也存在刷单行为。对刷单行为的单独立法，关系着网络信用评价体系的建立，也关系着整个网络产业和网络市场的发展。
