  2015年5月,一架小型飞机在安徽濉溪县坠毁,机上美国飞行员杰森和中国飞行员赵新宇遇难。根据事故鉴定,此次飞行是组织方无相应资质、不具备适航状态且未经许可的非法飞行,即称为“无执照飞行”。


  两名飞行员的家人根据事故调查报告认定的责任,将与此次飞行相关的北京乔海航空设备有限公司和河南乔治海茵茨飞机制造有限公司以及两家公司的负责人陈伟诉至法院。

  中国和美国两飞行员“无执照飞行”遇难


  去年5月3日,一架小型飞机从安徽濉溪县起飞几分钟突然坠毁,机上中国飞行员赵新宇和美籍飞行员杰森遇难。


  对于这起事故的原因,民航华东地区管理局做出的《事故调查报告》分析称“由于事发前事发单位或者当时飞行员未将此次飞行任务向有关单位报告,飞机上也未安装飞行记录设备,故不能对此次事件作出客观分析。”


  重案组37号(微信ID:zhonganzu37)了解到,该报告对此事故得出的结论是,涉事飞机属北京乔海航空设备有限公司(简称乔海公司)生产,但未取得中国民航的型号认可证和生产许可证;未取得中国民航的适航证、国籍登记证和民用航空器电台执照。


  调查报告指出,机上执行飞行的一名外籍飞行人员未持有中国民航飞行执照或执照认可函;此次活动未向军、民航空管部门申报;此次事件为一次非法飞行的通用航空一般飞行事故。而这种未经登记的飞行,即所谓的“无执照飞行”。


  调查报告还显示,乔海公司以及涉事的河南乔治海茵茨飞机制造有限公司(简称乔治海茵茨公司)实际控制人为陈伟。事故中飞机的零部件是由陈伟委托北京一家公司进口,在京完成装配,于去年4月,运至乔治海因茨公司。


  事发后,赵新宇的父亲赵兰生先是将安徽濉溪县政府起诉到法院,要求当地政府对此次事故调查报告进行批复。代理律师介绍说,政府一旦对事故调查报告进行了批复,就意味着对调查报告中的事故性质、原因和后果做出了最终的确认。此后赵兰生撤诉,并且起诉了事故报告中认定的相关责任人。

  遇难者家属诉“无执照飞行”公司


  截至目前,这次坠机事件已经过去18个月,赵兰生将《事故调查报告》中认定与坠机事件相关的乔海公司、陈伟、乔治海茵茨公司诉至法院,美国飞行员杰森的父母也委托律师起诉了上述三名被告。


  赵新宇和杰森的起诉书显示,三被告在明知乔海公司、乔治海茵茨公司不具备相应资质,不具备适航状态的情况下,由陈伟指令两家公司组织实施并使用该飞机进行非法飞行,造成飞行事故,导致赵新宇和杰森在事故中丧生,两名飞行员家属遭受了巨大的经济损失和精神痛苦。


  根据《侵权责任法》第8条“二人以上共同实施侵权行为,造成他人损害的,应当承担连带责任”的规定,三被告应向原告赔偿丧葬费、被抚养人生活费、死亡赔偿金、精神损害抚慰金等损失,并承担连带责任。赵新宇的父母则提出了包括20万元精神损害抚慰金在内的182万元的赔偿。杰森父母要求三被告赔偿包括10万元精神损害抚慰金在内的167万余元的赔偿。

  被告称飞行员明知“无执照飞行”


  今年11月12日,此案在密云法院开庭,三被告委托一名律师应诉,陈伟亲自到庭。


  三被告答辩称,对原告方陈述的事实经过没有异议,但飞机坠毁的事情与陈伟和乔治海茵茨公司没有关系,原告起诉没有依据。被告方还提出,杰森是这次航空事故的直接侵权人,应该承担侵权责任,现在杰森死亡,要求追加作为杰森继承人的其父母为被告。赵新宇明知无执照飞行还要参与,在此次事故中存在过错,应当相应减轻被告的赔偿责任。


  陈伟表示,杰森和赵新宇都是持有飞行驾照的飞行员,在此情况下,两人都进行了此次飞行,杰森在美国没有工作,是自己邀请他到国内“来玩”,而赵新宇是听别人说自己公司的飞机性能好于是过来试试,并不是自己公司请来的。


  陈伟说,他邀请杰森过来一起飞,是觉得“有义务通过自己的举动向国人展示,低空飞行并不是什么不得了的事情”。


  重案组37号(微信ID:zhonganzu37)了解到,被媒体称为“无执照飞行狂人”的陈伟曾于2014年4月8日,驾驶一架小型飞机降落在绵阳北川新县城的一个加油站,迈出舱门要工作人员给飞机加油。这段飞机开进加油站的视频火爆网络,陈伟因为“无执照飞行”被相关部门处罚60万元。

  判决:公司组织“无执照飞行”惹祸


  法院审理后认为,民用航空器造成他人损害的,民用航空器的经营者应担承担侵权责任。本案中,涉事航空器未取得中国民航的型号认可和生产许可证,未取得中国民航的适航证、国籍登记证和民用航空器电台执照。且涉事飞行活动未向军、民航空管部门申报,是一次非法飞行,涉事航空器的驾驶员杰森也未取得中国民航飞行执照或执照认可函,现乘坐该航空器的赵新宇在飞行事故中死亡,航空器的经营者应当承担侵权责任。


  乔海公司作为航空器的所有者,乔治海茵茨公司作为此次飞行活动的参与实施者,均应承担侵权责任。陈伟虽然是两公司的实际控制人,但其行为应视为职务行为,所产生的法律后果由其代表的公司承受。


  法院就赵新宇死亡的赔偿金方面,支持了丧葬费、死亡赔偿金和被扶养人生活费的诉讼请求,并就赵新宇死亡给其家人带来的精神痛苦,酌定精神损害抚慰金10万元,但对于赵新宇的停尸费未予支持。


  法院一审判决乔海公司、乔治海茵茨公司两家公司赔偿赵新宇家人总计人民币1437869元。

  专家:需要有效惩戒措施解决“无执照飞行”


  北京法学会航空法学研究会常务副会长张起淮律师表示,判决是严格按照《侵权责任法》和《航空法》做出的,没有认定飞行员有过错,并做出了最高额的精神抚慰金赔偿,让飞行员家属得到心灵上的一定的宽慰。


  同时张起淮认为,判决缺少对通航领域存在的无执照飞行情况做出有效的针对性的司法手段,没有有效的惩戒措施来解决目前的“无执照飞行”问题,案件在其他国家,可能会有很高的金额作为惩罚性赔偿,而在这个案件中,陈伟作为实际控制人,不需要承担民事责任,但是法庭可以对这种“无执照飞行”组织者以及民航各个分局提出司法和行政方面的建议。
