而基于美国的一贯逻辑，全球领海12海里外统统是“国际水域”（International Waters ），美国军事力量拥有绝对的行动自由，活动权限等同于公海。照此逻辑，美国也不承认中国在这个位置有专属经济区或历史性权利。
目的
按照美方自己的说法，该系统被用于在全世界各地搜集军事海洋地理信息，这艘UUV当时正在测量事发海域的盐度、水温以及声速，一副冠冕堂皇的模样。
可事实上，从专业角度而言，这种说法是毫无说服力的。全球海洋面积广袤无际，有3.61亿平方公里，美军为何专注在南海测量？如果是一般意义上的盐度、水温和声速等基本数据，早就有现成的，犯得着大动干戈亲自去测吗？
显然，美军测的不是基本数据，而是局部区域的细微变化，如水温差和声速差。众所周知，潜艇在水下行驶，往往会带来局部水域的温度、声波等基本水文参数的变化。无疑，这艘UUV的目的就是在探测潜艇，甚至可能是在跟踪潜艇。
报道称，这次被中国捞走的UUV，是美国泰里达因公司研制的斯洛克姆无人水下滑翔机（Slocum glider）。2014年，美国海军与泰里达因公司签署协议，将这种UUV用于军事用途，从2015年开始被用于在亚太地区执行水文调查任务。与传统UUV不同，该系统使用类似重型鱼雷上的热动力技术，因此续航力和推进效率远高于普通的电动UUV——2009年，斯洛克姆公司的一架水下滑翔机用221天从新泽西航行到西班牙，首次完成跨大西洋航行。该系统还可以在水下以编队方式航行，实施大范围的情报搜集。

对于美国贼喊捉贼的说法，记者有几点意见。
首先，关于无人系统的海上通行与海洋活动，国际法方面尚属空白，国际海洋法学界对是否赋予无人系统与有人系统同等的权利持谨慎意见。因此，不论事发海域是公海、专属经济区，还是有历史性权利的水域，美国都无法以“违反航行自由”规则来指摘中国，只能以主张财产所有权的名义来向中国发难。所谓的“主权豁免”，更是无稽之谈，中国是在海上捞的，又不是从美国船上扒过来的，离开了母船，这艘艇有无国际法主体地位都有待商榷。
其次，从维护自身利益和安全的角度来看，中国的做法无可厚非。这些无人系统明摆着在侵犯中国有人系统的安全，即便赋予这类无人艇一定的法律主体地位，它也无法与中国有人船只的法律地位相比。如果它妨碍了中国船只的航行自由，甚至危及到中国船只的安全，中国只能对它采取措施，不能坐等危险事件发生。这不，美国自己也承认，这艘船出了故障，那万一撞了别人怎么办？
最后，《公约》等国际法对海上军事行为缺乏充足的管辖权，既没有明确规定美军这样的抵近侦察、特别是无人艇与无人机的行动是否合法，同样也没有规定中国这样的打捞行为是否合规。这就是灰色地带，美军无人艇能过来，中国当然就能进行抓扣。
本来是彼此心照不鲜的套路，美国非得要在嘴上“找回来”。如果美国继续不依不饶的要中国归还其所谓的财产，中国可考虑郑重向美国抗议，这艘艇严重危及到中国船只和人员的安全，要求美国做出说明并道歉。问题是，为了这艘几万美元的东西（当然整个系统的价值肯定不菲），美国会低下头来道歉吗？
中国军队向来是文明之师，此次果断出手，必然事出有因。美国要想以德服人，不妨把故事讲全，再让天下人辨别是非。
