　　法制晚报讯（深度记者 李明德）14日至16日，备受社会关注的山西晋城程幼泽（绰号程三）因高调出狱，被晋城市检察院指控涉嫌聚众扰乱社会秩序一案，在晋城市阳城县人民法院公开开庭审理。原计划公开开庭审理三天，因该案涉及包括程幼泽在内的被告人有14人，相关证人多达323人。庭审一直持续到18日下午16时30分结束，经合议庭合议后，审判长宣布该案将择期宣判。

　　法晚记者从庭审获悉，晋城监狱副监狱长因对此事处置不当，被暂停职务。其他涉案狱警均受到不同处理，其中一名涉案狱警被逮捕。公诉方阳城县人民检察院建议因程幼泽等人属累犯，应当从重处罚。

　　此外，律师则为程幼泽做无罪辩护。

　　14日上午8时30分，山西晋城程幼泽因高调出狱一事，被晋城市阳城县检察院以涉嫌聚众扰乱社会秩序罪名提起公诉，阳城县人民法院公开开庭审理了此案。

　　法晚记者在起诉书中看到，2016年5月，程幼泽多次通过晋城监狱狱警王鹏传递消息、使用王鹏的电话联系、违规安排会见等方式，与被告人刘欣、贺正香、邢峰军（另案处理）等人商量，让多找点人、找些好车，为其组织出狱迎接仪式。

　　5月15日，程幼泽先后向刘欣、李国林传递到晋城监狱会见消息。16日，刘欣、贺正香等人在晋城监狱狱警张宏庆的违规安排下会见了程幼泽，商量了出狱迎接事宜。刘欣、贺正香在会见结束后，根据程的意图，又到李国林家中，同李国林、刘会泽等人商定，要多找些人、找些好车前往晋城监狱迎接程幼泽出狱。

　　5月17日，刘欣、蒙广录、贺正香、赵峰等人在刘欣经营的欣荣寄卖行，对迎接程幼泽出狱事宜再次进行商量，并商定找人找车、列队欢迎、就餐等相关事项。

　　随后，蒙广录指使赵峰具体策划迎接程幼泽出狱仪式。赵峰策划并设计了在程幼泽出狱时，由身着统一服饰的人（黑色短袖T恤、黑色裤子）列队夹道欢迎，统一喊口号的欢迎仪式。并于5月17日、22日，在欣荣寄卖行等地与刘欣、蒙广录等人对该欢迎仪式进一步商议。其间，赵峰于5月17日购买了19件纯黑色半袖及1件纯白色半袖，并安排其经营的“赵枫视频工作室”员工十余人统一着黑色半袖、黑色长裤参与迎接活动。

　　根据检方指控，晋城监狱共三次增派武警至约30人。李志宏称，平常释放刑满人员也会有武警，一般是武警三人小组，守在监狱大门。

　　李志宏称：“当天上午11点钟，我看到接程幼泽的人摆了很多鞭炮，通过和一名穿白衣男子交涉，他们把鞭炮撤到管教大楼挡车杆东边一百米外。中午12点钟下班后，我就回家了。当时并不清楚程幼泽释放出来后搞了欢迎仪式，燃放了鞭炮。”

　　李志宏表示，网上流传的视频，还是当天下午朋友转发他后才看到，才知道他们搞这么隆重，影响这么大。

　　在法庭上，李志宏称程幼泽出狱时的视频，自己看后觉得程幼泽太嚣张了，而且给监狱及政法系统造成很恶劣的影响。他因对此事件处置不当，造成了重大影响，自己目前仍处于被停职状态。

　　检方建议

　　公诉方阳城县检察院认为，程幼泽等人聚众扰乱社会秩序，情节严重，致使国家机关工作无法进行，造成严重损失。其犯罪事实清楚，证据确实、充分，应当以聚众扰乱社会秩序罪追究程幼泽等人的刑事责任。又因程幼泽、程会林、毕鹏三人属累犯，应当从重处罚。

　　6月10日，山西省公安厅发布信息，确认程幼泽已于6月8日被“依法批准逮捕”。同日，晋城中院对其减刑做出了裁定，该院裁定撤销之前对其的减刑。

　　据公开报道显示，程幼泽曾三次入狱，加上这次被批准逮捕，他已是“四进宫”。

　　1984年4月，程幼泽因犯抢劫罪被晋东南地区中院判处有期徒刑六年，1988年4月获释。

　　1996年12月，又因犯流氓罪、抢劫罪、故意毁坏公私财物罪、赌博罪被山西高院判处有期徒刑15年，2006年获释。

　　2009年10月，程幼泽第三次犯事被抓。2012年9月，他因犯非法买卖爆炸物品罪、故意伤害罪、非法拘禁罪被山西高院判处有期徒刑八年。

　　2016年12月14日至18日，程幼泽等人“涉嫌聚众扰乱社会秩序罪”一案在山西省晋城市阳城县人民法院公开开庭审理。
