山西省原副省长杜善学受贿8011万 被判无期徒刑

　　央视网消息：2016年12月20日，江苏省徐州市中级人民法院公开宣判山西省委原常委、山西省人民政府原副省长杜善学受贿、行贿、巨额财产来源不明案，对被告人杜善学以受贿罪判处无期徒刑，剥夺政治权利终身，并处没收个人全部财产；以行贿罪，判处有期徒刑三年；以巨额财产来源不明罪，判处有期徒刑七年，决定执行无期徒刑，剥夺政治权利终身，并处没收个人全部财产。对杜善学受贿所得财物和来源不明财产及其孳息予以追缴，上缴国库。

　　经审理查明：2003年至2013年，被告人杜善学利用担任长治市人民政府市长、中共长治市委书记、中共吕梁市委书记、中共山西省委常委、省委秘书长、山西省人民政府副省长职务上的便利，为相关单位和个人，在企业经营、职务晋升、调整等事宜上提供帮助，直接或者通过其妻等人非法收受上述人员给予的财物，共计折合人民币8011.4686万元。2011年，被告人杜善学在山西省委班子换届时，为得到时任山西省政协副主席令政策的推荐、支持，在山西省政协令政策的办公室送给其10万欧元，折合人民币90.665万元。

　　另外，被告人杜善学及其家庭有不能说明来源的财产共计折合人民币8961.7535万元。

　　徐州市中级人民法院认为，被告人杜善学的行为构成受贿罪、行贿罪、巨额财产来源不明罪。鉴于杜善学到案后，能够如实供述犯罪事实，主动交代了办案机关未掌握的大部分受贿犯罪事实；在被追诉前，主动交代其行贿犯罪事实；归案后主动交代赃款、赃物藏匿地点，相关款物已被追缴。依法可以从轻、减轻处罚。
