上海金山区原副区长陆瑾受贿获刑5年 罚金40万

　　12月26日下午2点，上海市一中法院依法对上海市金山区人民政府原副区长陆瑾受贿案作出一审判决，以受贿罪判处被告人陆瑾有期徒刑五年，并处罚金人民币四十万元。违法所得予以追缴。

　　上海一中法院经审理查明，2007年11月至2014年12月间，陆瑾利用其担任上海市青浦区赵巷镇镇长、党委书记的职务便利，接受原单位同事崔某的请托，为崔某的合伙人濮某在承接赵巷镇市政工程中提供帮助，多次收受崔某给予的现金共计115万元。

　　不仅如此，2014年7月至12月，陆瑾在担任上海市金山区副区长期间，还利用职权、地位形成的便利条件，接受上海市青浦区赵巷镇一公职人员王某的请托，违反干部选拔任用的有关规定，向上海市青浦区有关部门打招呼，为王某职务晋升谋取不正当利益。期间，陆瑾多次收受王某给予的钱款共计15万元。上述请托人员均已另案处理。

　　上海一中法院审理后认为，陆瑾身为国家机关工作人员，利用自己的职务便利，为请托人谋利；陆瑾还利用其职权、地位形成的便利条件，为请托人谋取不正当利益，非法收受他人钱款共计130万元，其行为已构成受贿罪。综合考虑全案事实、犯罪情节、社会危害程度及被告人的认罪态度等因素，法院遂作出前述判决。

　　法院宣判后，陆瑾当庭未表示上诉。
