昨日，记者从江苏省高级人民法院获悉，一彩票店老板，以盈利为目的，利用微信群竞猜彩票，短短10多天内就吸引了100多人200多万元滚动投入，获利近30万元。

贾木开设了一家彩票店，生意其实还不错。因为他之前在微信中参与过类似的赌局，输了不少钱，便想到自己何不也开设一个这样的“赌场”。今年6月到7月8日，他建立了一个微信群，并在网上招聘了两名年轻人刘强和张媛帮忙运营，以江苏体彩中心“11选5”玩法所开出的第一个数字为竞猜对象，通过猜数字、大小、单双的方法，组织他人进行赌博，累计参赌人数100多人，违法所得29.6万多元。
由于参与人数逐渐增多，加上人数限制，原本的微信群已经不能满足需求，贾木等人每隔几天就会更换微信群，不断吸纳参赌人员前来投注。
稳赚不赔的“秘诀”
之所以能在短短的时间内吸引那么多人参与其中，主要是利用一些精心计算过的数字骗局，让人误以为可以从中得到甜头，实际上，无论参赌者运气多好，贾木也能稳赚不赔。
到底是什么“秘诀”能够稳赚不赔？本案承办法官史友兴介绍说：“我们打个比方，他有一个猜大小的玩法，按照规则1-5为小、6-10为大，按照投注人来讲，他能猜中的比例是1/2，但是被告人设置的赔付比例是1.8倍。他们还有一个是猜数字的玩法，就是1到10，如果猜中了要赔9倍，如果猜不中，赔注的钱全部没收。这样我们就可以看到了，被告人设定的赔付的概率永远是小于参赌人员投注的概率。因为他设定的概率虽然是小于参赌的概率，但他的差距是比较小的，这样参赌的人员能够赢钱的概率也是比较多的，所以他不断增加投注的数额，实际上他们并没有注意到，他赢钱的概率是小于被告人设赌的概率，最终的结果都只会是赔钱的，而大部分钱肯定都是被设赌的赚走。”
非法获利30万被罚40万
今年41岁贾木，曾因犯聚众斗殴罪被判刑。法庭上，他对自己的犯罪事实没有异议。他后悔道：“我希望法庭能给我一个重新做人的机会，我现在上有老下有小，另外开彩票店也投资了不少钱。这次应该是个惨痛的教训，以后一定好好做人、重新做人，回报社会和家庭。”
法院审理后认为，被告人贾木、刘强、张媛以营利为目的，开设赌场，其行为已构成开设赌场罪。被告人贾木在共同犯罪中，起主要作用，是主犯，被告人刘强、张媛起次要作用，是从犯，应当减轻处罚。被告人贾木犯罪后自动投案，如实供述自己的罪行，是自首，可以减轻处罚。
法院当庭宣判：被告人贾木犯开设赌场罪，判处有期徒刑两年六个月，缓刑两年六个月，并处罚金人民币四十万元。判处被告人刘强有期徒刑六个月，缓刑一年，并处罚金人民币两万元。判处被告人张媛有期徒刑六个月，缓刑一年，并处罚金人民币两万元。(文中人物系化名)
