　　北京市文化局原副局长张晓利用其先后担任北京电视台总编辑、北京市文化局副局长、北京文创国际集团有限公司法定代表人等职务便利，为他人谋取利益， 非法收受财物110万余元。今天上午，一中院作出一审判决，法院认定张晓构成受贿罪，判处其有期徒刑6年，并处罚金100万元。

　　案情

　　帮人参演北京春晚 受贿百万

　　今年53岁的张晓博士研究生文化，案发前是北京市文化局原副局长、原文创集团有限公司法定代表人。

　　法院审理查明，2009年下半年至2010年3月，张晓利用担任北京电视台总编辑的职务便利，接受赵某请托，为赵某之女进入北京电视台工作提供帮助。

　　2010年春节前后，张晓收受赵某给予的200克金条一根，价值人民币4.7万余元。

　　2009年底至2013年9月，张晓利用先后担任北京电视台总编辑、北京市文化局副局长以及文创集团筹备组负责人、法定代表人、总经理的职务便利，接受陈某请托，为陈某之友参演北京电视台2010年春节联欢晚会等多个节目、文创集团承办的歌会等提供帮助。

　　2010年11月至2014年下半年，张晓先后4次收受陈某给予的港币100万元（折合人民币78.6万余元）、酒店消费卡3张（价值人民币29.8万余元），共计折合人民币108.4万余元。

　　否认指控 称不具受贿主观故意

　　据了解，一审庭审时，张晓不认罪。张晓称，他并未利用职务便利帮助赵某之女进入北京电视台工作，赵某给其金条是朋友之间的馈赠。

　　张 晓表示，他在北京电视台和文创集团任职期间，具有节目制作的决策权，他是基于正常工作安排宣传、推广。陈某鉴于他为其公司提供了诸多咨询帮助，以及想招聘 他到公司工作而才给予的财物，他不具有受贿的主观故意，他的行为不构成受贿罪。（法制晚报微信公号ID：fzwb_52165216）

　　判决

　　因受贿罪一审被判6年

　　一中院审理后认为，张晓身为国家工作人员，利用职务便利，非法收受他人财物，为他人谋取利益，其行为已构成受贿罪。

　　鉴于在案冻结、扣押了部分赃款、赃物，可对张晓酌予从轻处罚。

　　一中院据此作出判决，以受贿罪判处张晓有期徒刑6年，并处罚金100万元。

　　宣判后，张晓的辩护人表示肯定要上诉。
