#法晚深度即时#（记者张恩杰）法制晚报记者今晚刚刚获悉：湖南省湘潭市人大代表李福坤向原选举单位湘乡市人大常委会提出辞去湘潭市十五届人大代表职务，经湘潭市人民代表大会常务委员会代表资格审查委员会审查确认，终止李福坤的湘潭市第十五届人民代表大会代表资格。而在12月24日，法制晚报报道了李福坤为自己兴建活人墓，被当地国土、民政部门要求整改的 新闻事件，随即在25日下午，李福坤雇用吊车拆除了活人墓及其周围的石马、石仙等石像。
据湘潭市人大官网上的湘潭市第十四届人民代表大会常务委员会公告（第十九号）显示，因李福坤本人向原选举单位湘乡市人大常委会提出辞去湘潭市十五届人大代表职务，湘乡市第八届 人民代表大会常务委员会第一次会议依法依程序接受了李福坤的辞职。按照《代表法》的相关规定，经湘潭市人民代表大会常务委员会代表资格审查委员会审查确认，终止李福坤的湘潭市第 十五届人民代表大会代表资格。
对此，法晚记者通过电话向李福坤本人求证，其称自己今年67岁，年龄大了，身体不如从前，已不适宜再担任人大代表了，所以主动向原选举单位湘乡市人大常委会提交了辞职报告。而对 于记者所提出的是否因为其为自己修建活人墓被媒体曝光后，社会声誉大受影响而被动请辞这一问题，李福坤断然否认，他称活人墓是自己所处的整个家族修建的，包括其哥哥也都参与了。 所以这账算到他一个人头上，他觉得有点冤。
据了解，《国家殡葬管理条例》是于1997年7月21日生效的，该条例明确规定任何单位和个人，未经批准不得擅自兴建殡葬设施。在允许土葬的地区，禁止在公墓和农村的公益性墓地以外 的其他任何地方埋葬遗体、建造坟墓。
而李福坤此前接受法晚记者采访时称，他们家族的活人墓是从2000年陆续开始修建的，墓旁的石马、石狮、石仙等石像是他在中国各地洽谈生意时，见到好的石像，就掏钱购买下来，这样 越积越多，所以并不是专门找石匠订做的。另外其在一块大石板上为自己镌刻了墓志铭，上面写着“乘着改革开放之东风，凭自己之勤劳智慧，创办湘乡岐园机制砖厂，一举迈入小康。1998 年当选湘潭市第十一届人大代表；2002年，2012年继续当选湘潭市第十二届、十四届人大代表，并均被选为人大常委会委员……”
李福坤向法晚记者表示，他已担任了将近20年的湘潭市人大代表。“我觉得我没有触犯到其他法规，只是违反了 《殡葬管理条例》，那时对于法律知识知之甚少，也不晓得有此条例。”
值得一提的是，李福坤还向法晚记者确认，他因兴建活人墓被当地村民实名举报，湘潭市人大常委会于今年10月份对他诫勉谈话一次，当地国土、民政部门在11月底给他下达了整改通知书 。
而在湘潭市人大官网于12月22日发布的湘潭市人民代表大会常务委员会（第十八号）公告中，湘潭市第十五届人民代表大会代表名额351名，其中在湘乡市（88人）这一栏里，有李福坤的姓名。该公告称，2016年11月22日至30日，经由各县（市、区）人民代表大会和驻湘潭部队军人代表大会选举产生湘潭市第十五届人民代表大会代表348名；2016年12月9日，经湘潭市第十四 届人民代表大会常务委员会代表资格审查委员会审查，确认湘潭市第十五届人民代表大会348名代表资格合法有效。
这第十八号公告公布6天时间后，就以第十九号公告来确认终止李福坤的湘潭市第十五届人民代表大会代表资格。从12月9日代表资格生效到28日资格终止，李福坤履职二十天，经历了因兴建活人墓而被新闻媒体曝光，身陷舆论漩涡雇吊车拆除活人墓，再到请辞人大代表，常委会接受、审查、确认、终止其人大代表职务的过程。
