北京回龙观镇原书记贪贿3400万
法制晚报讯（记者 唐李晗）昌平区回龙观镇原镇委书记郭向东，利用职务便利收受财物1400余万元，还伙同他人侵吞2000万元公款，法院一审以受贿罪、贪污罪判处郭向东有期徒刑16年。郭向东不服上诉，北京市高院终审改判，以受贿罪、贪污罪判处郭向东有期徒刑13年，并处罚金70万元。
郭向东历任北京市昌平房地产开发有限责任公司（以下简称昌房公司）党委书记、总经理，北京铭嘉房地产开发有限公司（以下简称铭嘉公司）董事长、总经理，昌平区百善镇委员会党委书记、回龙观镇委员会党委书记。
一审法院查明，2004年至2007年间，郭向东利用担任昌房公司党委书记、总经理的职务便利，伙同某温泉公司法人裴某（另案处理），在昌房公司向某房地产公司转让某小区项目的过程中，虚构该项目转让系温泉公司介绍并促成的事实，以支付温泉公司中介费的名义，骗取昌房公司人民币2000万元，后予以侵吞。
2004年至2014年间，郭向东先后利用在昌房公司、铭嘉公司以及昌平区百善镇、回龙观镇担任领导干部，全面负责昌房公司、铭嘉公司经营管理，主持百善镇、回龙观镇工作的职务便利，为他人牟取利益，多次收受他人给予的财物共计折合人民币1400余万元。
此案开庭时，郭向东认罪，法院一审以贪污罪判处郭向东12年，并处罚金60万元；以受贿罪判处郭向东12年，并处罚金60万元，决定执行有期徒刑16年，并处罚金120万元。认为量刑过重，郭向东上诉。
北京市高院审理认为，郭向东身为国有公司中从事公务的人员，利用管理、经营国有资产的职务便利，伙同他人骗取国有财产，数额特别巨大，已构成贪污罪；郭向东利用在国有公司、国有控股公司或国家机关中从事公务的职务便利，非法收受他人财物，为他人牟取利益，已构成受贿罪。
鉴于郭向东贪污犯罪属于自首，认罪悔罪，且能主动退缴全部赃款，法院对其贪污罪减轻处罚；鉴于郭向东受贿犯罪属于本人主动坦白绝大部分犯罪事实，有悔罪表现，法院对郭向东所犯受贿罪从轻处罚。根据中国宽严相济的刑事政策和郭向东认罪认罚的具体情况，应当对郭向东在确定从宽幅度时予以考虑。
最终，北京市高院以郭向东犯贪污罪，判处有期徒刑6年，并处罚金人民币20万元；犯受贿罪，判处有期徒刑11年，并处罚金人民币50万元，决定执行有期徒刑13年，并处罚金人民币70万元。
