　　法制晚报讯（记者 洪雪） 国家食品药品监督管理总局药品审评中心原副主任尹红章，利用职权为浙江、上海、辽宁等多家疫苗企业在药品申报、审批等事宜上提供帮助，单独或与妻子郭某、儿子尹某晨非法收受或者索取财物356万余元。

　　《法制晚报》记者上午获悉，一中院一审以受贿罪判处尹红章有期徒刑10年，并处罚金50万元。据悉，其妻郭某因帮收150余万元，一审被判处有期徒刑3年，缓刑5年；其子帮收107万余元，一审被判处有期徒刑两年，缓刑3年。

　　案情 为药企提供帮助 收受财物356万元

　　公开资料显示，药审中心是国家食药监总局的直属单位，负责对药品注册申请进行技术审评，参与起草药品注册管理相关法律法规、部门规章和规范性文件，组织协调省级药品审评部门对部分注册申请事项进行技术审评，并进行质量监督和技术指导等。

　　现年59岁的尹红章长期担任原国家药监局药品注册司生物制品处处长，2010年9月，尹红章开始担任国家食品药品监督管理总局药品审评中心副主任，负责生物制品审评方面的工作，分管生物制品药学部、研究与评价部等多个部门。

　　2015年4月，尹红章被带走调查，两个多月后国家食药监总局发布通知，免去他国家食品药品监督管理总局药品审评中心副主任的职务。

　　尹红章的妻子郭某在证言中称，2015年春节前，尹红章回家后表现得很紧张，又让儿子给一药企业老板庄某退钱。她说当时自己很害怕，觉得要是尹红章被查，家里放太多现金说不清楚，于是就将家中的220万元现金暂存在弟弟家。

　　尹红章被查获后，主动交代了办案机关尚不掌握的大部分受贿事实。赃款、赃物已全部追缴。

　　法院审理查明，2002年至2015年间，尹红章利用其担任国家药品监督管理局药品注册司生物制品处处长、国家食品药品监督管理局药品注册司生物制品处处长和药品审评中心副主任的职务便利，为北京、浙江、上海、辽宁等多家公司在药品申报审批等事宜上提供帮助，单独或者分别与其妻子郭某、儿子尹某晨收受或者索取财物折合人民币356万余元。

　　判决 自首认罪全部退赃 因受贿判10年

　　庭审时，尹红章认罪。

　　法院认为，尹红章身为国家工作人员，单独或伙同他人，利用职务便利，向他人索取财物；利用职务便利，非法收受他人财物，为他人谋取利益，其行为已构成受贿罪。尹红章的行为严重侵害了国家工作人员职务行为的廉洁性，应予惩处。

　　尹红章在伙同他人共同受贿的犯罪事实中，系主犯。尹红章具有索贿情节，应予从重处罚。鉴于尹红章到案后，能够如实供述司法机关尚未掌握的其他同种罪行，且涉案赃款、赃物均已追缴，故对其从轻处罚。一中院一审以受贿罪，判处尹红章有期徒刑10年，并处罚金50万元。在案扣押的338万余元、象牙一根，依法予以没收。

　　妻子帮收150万被判刑

　　尹红章不仅自己收钱，其妻还帮助收了150万元。

　　2007年至2014年间，尹红章夫妇共同收受北京一家生物医药有限公司负责人白某给予的80万元。

　　尹红章称，2000年左右，白某成立了北京某生物医药有限公司，自己在担任药品注册司生物制品处处长期间，加快了对白某公司相关药品的审批进程，使相关药品于2005年获得新药证书、2008年获批上市。

　　自2007年起至2014年，白某几乎每年节日期间都会以请客吃饭或送水果的名义给尹红章送钱，每次5万至8万元不等，总数大约80万元。

　　最终，法院以受贿罪，判处郭某有期徒刑3年，缓刑5年，并处罚金20万元。

　　儿帮收钱 还在药企吃空饷

　　妻子帮收钱，儿子也牵扯其中。法院查明，尹红章伙同儿子尹某晨收受辽宁一家生物公司总经理庄某给予的钱款107万余元。

　　尹红章供述，2002年，辽宁这家公司从国外引进一种狂犬病疫苗，向国家食药监总局提出临床试验申请。2009年，疫苗被批准后，庄某将一个装有2万元现金的信封送到他家中表示感谢，他推辞一下就收下了。

　　2010年，庄某公司一项疫苗申报的临床试验方案缺少一次实验数据，在第一次审评会议中，药品审评中心内部有不同意见。第二次审评会议上，在尹红章推动下，申请顺利通过。此后不久，庄某将100万元以经营期货为名汇至尹某晨账户中，尹红章默认。此后庄某在沈阳成立了一家公司，欲招聘其子当员工，其子并未到该公司工作，但每月领工资。

　　2015年初，庄某称国家食药监总局监察人员在查其名下账户，尹红章认为可能在调查自己，于是与庄某商议让儿子把收到的100万元退还。

　　最终，法院一审以受贿罪判处尹某晨有期徒刑二年，缓刑三年，并处罚金10万元。

　　作案揭秘

　　疫苗标准低 收钱帮药企插队审批

　　云南一家药企公司经理刘某在证言中称，他2003年和尹红章相识。2008年以后，他与尹红章往来较多，也曾给尹红章送过钱。从2007年开始到2014年，每年春节，他都会请尹红章及家人在北京吃饭或者喝茶，每次都会送给尹红章一些现金。

　　刘某说，之所以给尹红章送钱，是为了能够拉近与尹红章之间的关系，方便药品审批。

　　尹红章供述称，2012年或2013年左右，该公司向国家食药监总局提交了一种疫苗的申报，当时使用的标准低，所以他反对通过审批。按照正常程序，应该让该公司退审后重新排队申报。但为了推动该公司发展，他要求该公司以补充提交的方式，先补交材料，再临床试验，使得该公司在审批程序上至少节约了三到五年的时间。

　　老板送象牙 称不知真假送人

　　尹红章收钱最早是在2004年。当时他接受浙江一家药企董事长丁某的请托，为该公司在药品申报审批事宜上提供帮助，并收受丁某给予的价值18万余元的象牙制品一根。

　　尹红章供述称， 2004年左右，丁某送给他一根象牙，当时用盒子装着。后来国家出台了打击象牙走私的规定，于是他在2010年把象牙送了人。

　　尹红章说，丁某之所以送象牙给他，是因为当时丁某公司有几个项目在国家食药监总局审批，他当时担任生物制品处处长，主管生物制品的行政审批，丁某想借此和他拉近关系，方便在审批中获得关照。

　　丁某的证言显示，他于1995年与尹红章相识。2004年元旦或者春节他到北京出差，当时尹红章是国家食药监总局生物制品处处长，他的公司正好有疫苗项目在该处申报审批，他临时打算去看望尹红章，安排公司驻京办主任约尹红章见面。见面时，他和尹红章客气了几句，就将一根象牙放在了尹红章车的后备箱中，并告诉尹红章这是一件工艺品。

　　尹红章的妻子郭某证言显示，2004年左右，她在家中发现一个硬纸盒，里面放着一根六十厘米左右的象牙。后来尹红章说，“这个象牙不知道真假，咱们也没这个爱好，干脆送人吧。”后来尹红章就把象牙送人了。

　　药企老板送钱 花椒袋下放现金

　　成都一家药企公司总经理周某称，2011年12月，该公司疫苗没获得审批，她得知尹红章到成都参加会议入住锦江宾馆后，主动联系尹红章，说有点事想咨询。尹红章说还在开会，只能出来一下，她就和尹红章约在酒店大堂见面。

　　周某表示，见面后，她介绍了自己公司的情况，请尹红章理解和支持。尹红章当时比较认可，说会给予支持。随后她把一个下面装有5万元现金、上面压了两袋花椒的纸袋给了尹红章，说是一些土特产。尹红章称还要开会，她让服务员把东西放到尹红章的房间。

　　后来尹红章看到钱还给周某打电话，说“没必要，太客气了”。

　　尹红章供述，周某给钱，是希望他关照一下该公司的项目，他同意了。后来经他签字审批，周某公司生产的疫苗通过了技术审评。

　　自己有钱不用 趁买房向药企借30万

　　尹红章称，他1995年前后与尹某相识，因工作关系两人经常一起开会，并由此熟识。2002年，尹红章调任药品注册司生物制品处处长后，尹某公司申报过甲肝疫苗、SARS疫苗、禽流感疫苗、手足口病疫苗、甲流疫苗等项目，尹某为了能够在药品审批上获得照顾，两人之间一直有经济来往。

　　2006年上半年，尹红章分得住房一套，为装修新房，他和郭某到尹某刚装修完的住处参观。在参观时，尹某给了他一个装有5万元现金的信封，尹红章直接将信封给了妻子。

　　2011年，尹红章购买小产权别墅期间，以借款为名向尹某要了30万元。尹红章称，家中有钱，但都由妻子保管，妻子不愿意拿钱出来，于是找尹某要了30万元。

　　尹红章承认，他确实帮助尹某的公司推动过审批进程。

　　尹某在证言中称，他所在公司生产的疫苗属于生物制品，因为尹红章当时是药审中心副主任，对他的公司存在监管关系，为了让尹红章在药品审批方面能够关照，所以尹红章张口借钱他不能不同意，“尹红章口头上说是借钱，其实就是要钱。”

　　尹某表示，“当时担心直接给尹红章钱会有麻烦，于是我和妻子商量，由妻子出面将30万元借给尹红章的老婆郭某，并签了一份借款协议。”
