但是，在淘宝上搜索VR眼镜网店，很多都有“羞羞哒看电影神器”、“送海量福利”、“赠送劲爽资源”等宣传语。这些网店，在贩卖VR眼镜的同时，居然还送海量簧片，大量男性同胞似乎感受到了一股巨大的福利……
然而，这些卖家却已经涉嫌传播淫秽物品罪。证券时报记者从深圳市人民检察院获悉，首例案件已经在深圳发生。

据介绍，涉案人员中，年龄最大的1986年出生，刚刚30岁，绝大部分都是90后，甚至还有不满18周岁的未成年人。作为淘宝从业者，有的是老板、店主，有的是运营人员、销售主管，还有的是客服。对于销售VR眼镜为什么要赠送淫秽视频，解释基本上都是“增加VR眼镜销量”“积累客户资源”“客户给好评”等，从案件情况看，确实获利丰厚，有一家网店靠此每月销售收入高达差不多300万。甚至有犯罪嫌疑人直言不讳称“销售VR眼镜后向客户免费提供淫秽、色情视频已经是行业潜规则”、“这是我们这个行业里存在的一个普遍现象”……
他们是如何向用户赠送淫秽视频的呢？深圳检方介绍，从案件情况看主要是两种方式，一种是建立专门的QQ群，销售VR眼镜后引导买家加QQ，然后在QQ群给买家提供资源链接，或者在群上直接提供视频文件，有卖家为此专门建立了几十个QQ群，每个QQ群上高达一两千人；还有一种是将淫秽视频放在某网盘账户上，买家收到VR眼镜后让买家加其为某网盘好友，之后将资源分享给客户，供买家点击或下载，有的犯罪嫌疑人的某网盘上，甚至存有2000G的“A片”。
如犯罪嫌疑人熊某，在淘宝网上开设网络店铺销售VR眼镜，并雇佣徐某负责店铺运营、陈某负责客服，三个90后，为了增加店铺VR眼镜销量，在每一部销售出去的VR眼镜外包装上粘贴印有“送福利，送海量资源，爱情动作片，资源联系群管理：老司机，qq群……”字样的贴纸。顾客收到购买的VR眼镜后，可以通过该贴纸上信息在手机上下载3D播播app并加入qq群，通过点击犯罪嫌疑人熊某等人在qq群内发布的连接进入某网盘下载淫秽色情视频。经查：徐某等三人在qq群内共发布800多部淫秽色情视频连接，徐某的某网盘中存有数百部淫秽色情视频。2016年12月21日，宝安区人民检察院对熊某等三人，依法以涉嫌传播淫秽物品罪批准逮捕。
还有的网店老板，明知员工在销售VR眼镜中赠送淫秽视频，而予以纵容。如犯罪嫌疑人徐某，作为一名22岁的女性，刚大学毕业，替父亲打理网上旗舰店，明知多名员工在销售售VR眼镜过程中，向客户提供淫秽视频资源，却认为是“能招揽更多的客户”“潜规则”而予以纵容。2016年12月22日，宝安区人民检察院对徐某及两名员工，依法以涉嫌传播淫秽物品罪批准逮捕。
宝安区人民检察院检察官胡国蕾表示，目前网上确实存在着一定的VR眼镜色情营销的乱象，作为一名法律工作人员，在普法的同时也提醒卖家，切勿为了逐利而触碰法律的底线。“希望整个行业能加强行业自律，摒弃一些潜规则；也希望这些网络交易平台能加强对产品发布的审核，加大监管力度，对这种附加赠送淫秽视频的违法行为进一步打击；而云储存方面，也可以进一步加强识别、提示及封锁的功能。希望通过大家的共同努力，能进一步有效地净化我们的网络环境。”
