　　今年8月24日晚，时任大关县机构编制委员会办公室主任的郭玉驰见到一名幼女(2009年出生)在路边玩耍，遂起奸淫之心，便将其抱至家中实施奸淫。随后，郭玉驰被捕并移交检方起诉。检方起诉建议以强奸罪判处其有期徒刑3至5年。

　　9月24日，大关县法院对郭玉驰强奸4岁幼女案做出一审判决，认定公诉机关指控罪名成立，且奸淫未满十四岁幼女应从重处罚。但郭玉驰归案后能主动供述犯罪事实，认罪态度较好，应综合全案情节予以处罚，判处有期徒刑5年。原告未提供相应证据证明其经济损失情况，同时精神损害赔偿不属于附带民事诉讼范围，均不予支持，判处郭玉驰不承担民事赔偿责任。

　　判决作出后，受害者家属认为量刑过轻、且没有赔偿，遂向大关县检察院提出抗诉请求，但遭到拒绝。随后，受害者家属就刑事部分依法向昭通市检察院提出申诉，并就80余万元民事赔偿部分向昭通市中级人民法院提起上诉。同时，受害者家属将遭遇发在网络上，大批媒体对此进行了报道，众多网民发表评论质疑处罚不当。

　　昭通市检察院受理申诉材料后，经过审查，认为大关县人民法院一审判决量刑明显不当，向昭通中院提出抗诉；昭通中院依法受理此案民事部分的上诉，并于10月17日决定，将郭玉驰强奸幼女案刑事部分指令大关县法院再审，民事部分发回重审，并要求大关法院合并审理。

　　10月25日，大关县法院就民事部分组织调解，双方达成民事和解，郭玉驰一次性赔偿受害人15万元，受害人法定代理人向法院申请撤回附带民事诉讼状。

　　12月3日，大关县法院依法对该案进行不公开审理。6日作出判决后，受害人家属以及代理律师认可该判决。(完)
