  “华南城十里东岸”别墅小区是广东省河源市最为知名的别墅群之一,其正在出售的别墅几乎全部都是国家明令禁止建设的独栋别墅,令人意想不到的是其“真身”竟是一个被称为“物流航母”的“商贸物流城项目”,正式名称为“东江商贸综合物流及配套商业住宅项目”。


  按规划,这个项目总投资约100亿元,计划建成集工业原材料市场、建筑材料、物流配送以及金融结算等功能于一体的超大规模综合商贸物流平台,面向泛珠三角地区,连通粤、赣和华中地区。


  2009年,这个项目被列为省级重点项目。紫金县对该项目的支持更是不遗余力,为保证项目上马,甚至存在“先占后征”、“少征多占”等违法征地现象。


  据《经济参考报》记者了解,这个项目包括主体部分“东江商贸综合物流城”和配套部分“配套商业住宅”,整个项目于2009年7月破土动工,一晃4年过去,作为项目“配套”的豪华别墅小区早就拔地而起,而被外界寄予厚望的项目主体“东江商贸综合物流城”,却不见踪影。


  本报记者调查发现,这个项目主体和配套的关系,本末倒置:从规划面积看,项目配套2.6平方公里(约3900亩),而项目主体———“综合物流城”却仅有1平方公里(1500亩);从修建时间看,先做配套,最后才做项目主体;从用地看,通过“招拍挂”拿到1700亩土地,全部用来配套别墅,而项目主体至今尚无任何用地。


  其间还发生过一个插曲。2011年11月18日,紫金县和华南城搞了一个“东江商贸综合物流城”动工仪式。


  “动工仪式,不过是掩人耳目。”一位知情人说,“物流航母”变成“别墅航母”充分说明,做物流城其实就是一个幌子,醉翁之意不在酒。

  本报记者在当地调查获得的资料证实了这个说法,资料显示,在2009年4月21日,紫金县政府与华南城下属企业华南城实业(河源)有限公司签订《关于在紫金县临江镇建设生态农庄旅游项目变更为建设东江商贸综合物流及配套商业住宅项目的补充协议》(以下简称《补充协议》),《补充协议》约定:华南城“配套商业住宅”项目首期用地2.66平方公里项目用地综合包干价为1.35亿元(协议附件约定这1.35亿元的土地包干价款其实为该地块的征地拆迁安置补偿预算款);如华南城按程序取得项目用地的土地使用权,由华南城与紫金县国土部门签订《国有土地使用权出让合同书》,华南城根据土地合同相关约定分期、分批向国土部门缴纳土地竞拍价款后,紫金县政府承诺于收到华南城每批次缴纳的土地竞拍款之日起10个工作日内,将华南城支付的土地竞拍款返还给华南城;在华南城支付缴纳的土地竞拍款的同时,紫金县国土部门应向华南城开具等额的土地价款收款收据。


  紫金县国土资源局局长黄海涛在接受本报记者采访时称:这不是“零地价”。国土资源部国土经济研究院一位专家在看完《补充协议》后认为:这就是一般意义上的“零地价”行为。


  而对于地方政府的“零地价”招商行为,国务院办公厅下发《关于规范国有土地使用权出让收支管理的通知》,强调从2007年1月1日起,任何地区、部门和单位都不得以“招商引资”、“旧城改造”、“国企改制”等名义减免土地出让收入,实行“零地价”,甚至“负地价”,或者以土地换项目、先征后返、补贴等形式变相减免土地出让收入。


  县政府向开发商承诺:若你不中标我赔你钱


  更为不可思议的是,在《补充协议》中紫金县政府还向华南城承诺,确保华南城在该土地的“招拍挂”中成功摘牌,否则紫金县政府将赔偿华南城巨额经济补偿。


  《补充协议》约定,如华南城按程序未能取得该项目用地的土地使用权而被第三方所获得时,紫金县政府同意并承诺在华南城发出通知起30天内,将华南城已支付的征地拆迁安置补偿款及申报用地指标已缴纳的费用等所有款项一次性全部返还给华南城,同时紫金县政府同意将“招拍挂”所得款扣除华南城已支付的土地价款后余额的80%一次性支付给华南城作为华南城在该项目上的经济补偿。


  有了该《补充协议》的保证,华南城在此后该宗土地使用权的“招拍挂”中顺利摘牌。


  国家之所以对土地出让采用“招拍挂”的方式,就是希望通过公开投标的方式进行阳光操作,遏制土地交易中的不当行为,维护土地交易的公平公正。


  “这些年来,虽然很多土地的‘招拍挂’存在走过场的质疑,但是像紫金县政府与华南城在土地‘招拍挂’招标前如此约定却极为少见,非常荒唐,令人震惊!该地块的招标其实已经涉嫌‘虚假投标罪’,相关部门应该及时介入调查。”中国政法大学教授谭秋桂认为。


  “因《补充协议》违反国家法律法规,所以在操作中,知道的人极少,只有县几个领导和华南城的少数高管知情,是秘密约定。”当地一位知情人士向记者透露。


  而对该项目土地“招拍挂”是否存在违法的问题,紫金县国土资源局局长黄海涛在接受本报记者采访时称:上面已经查过,对此不接受采访。
