被告人张某今年26岁，广西人。2008年开始，张某失业在家，听朋友说可以在网上购买QQ号进行诈骗，张某便在网上搜索。按照网页上的诈骗流程，张某先花了300元购买了一套木马程序和一个QQ号。根据QQ号的个人信息和聊天记录，张某发现之前使用该QQ号的人是位留学生顾某。随后，张某向该QQ中的每一位好友发送木马，等待对方“上钩”。张某称，收到木马的好友只要点开木马链接，自己就能获取对方的QQ密码，再根据聊天记录，就能猜出双方的关系。
今年5月，张某购买的QQ号有了动静，对方是顾某的母亲，要求视频。张某见时机来了，立即冒充顾某，和顾某的母亲聊天。张某称信号不好，不能视频。此时，顾某的母亲提出要打电话，张某谎称手机前两天掉水里了，还没有买新手机。
见对方相信，张某马上转移话题，称有件事要和“母亲”商量，其有个导师姓王，前两天回国，因为带的现金太多，就把其中78000元现金暂存在他那，本来打算在其导师回国后就将钱转过去，但这两天银行关门，没法转账，希望“母亲”能打个电话和其导师解释一下。
顾某的母亲听后没有怀疑，在拿到电话后拨通了“王老师”的电话，而电话那头正是张某本人。在一番寒暄后，张某称手上急用钱，要顾某想想办法，赶紧把钱汇过来。顾某的母亲听后又通过QQ将“王老师”的情况转达给了“儿子”。张某趁机提出，要家里先把钱垫上，等银行开门会把钱转回去的。顾某的母亲一口答应。
谁知，在按照“儿子”给的账号把钱打过去后，“顾某”立即下线了。再打“王老师”的电话也一直无人接听，顾某的母亲这才惊觉自己上当了。警方经过侦查，在广西南宁将张某抓获。
法院经审理查明后认为，被告人张某以非法占有为目的，骗取78000元，数额巨大，其行为已构成诈骗罪。在庭上，张某承认了自己的犯罪行为。在家属的帮助下，张某向受害人退还了78000元。根据被告人张某的犯罪情节和悔罪表现，结合刑事案件被告人审前评估意见，其符合适用缓刑的条件。
法官提醒：当下网络中盗取他人QQ或使用被盗的QQ等聊天工具并冒充使用者身份进行诈骗的情况较为多见。社会公众应提高防范意识，对于聊天工具中的亲人、好友、同事等突然提出的较大数额的借款、汇款要求要仔细核对。同时，网络犯罪并非所谓的“高科技”犯罪，并不能给犯罪者提供特殊保护，任何意图通过网络技术特征来逃避刑法处罚的幻想都是不现实的。
