Decentralization of the Ministry of environmental protection on 25 the EIA approval authority and strengthen the EIA regulation

In recent years because of environmental problems caused by construction projects of environmental group events occur frequently, the growing public concern for environmental impact assessment.

From four aspects of the guidelines increase the intensity of EIA information disclosure: a public environmental assessment report (table) all to make all information on public access to environmental assessment documents, in favour of more fully in the project review process for public comment, subject to public supervision. 　　新华网北京12月10日电（记者顾瑞珍）中国环境保护部日前发布公告，下放环评审批权限的建设项目共25项，主要是基础设施类和环境影响较小的项目，如分布式燃气发电、城市快速轨道交通、扩建民用机场等项目。

　　环保部还配套印发《建设项目环境影响评价政府信息公开指南》和《关于切实加强环境影响评价监督管理工作的通知》，旨在加大环评政府信息公开、强化环评事中事后监管。

　　同时，环保部将继续严格跨区域流域、环境影响重大、敏感复杂建设项目的环评管理，保留这些项目的环评审批权限。这些项目既包括“两高一资”和产能过剩的燃煤火电、钢铁、电解铝项目，存在较大环境风险的核与辐射项目，对生态影响突出的水电、有色矿山开发、千吨级以上通航建筑物内河航运、国家级自然保护区和风景名胜区内投资5000万元以上的旅游开发和资源保护项目等，也包括涉及重金属排放的新建和扩建铜、铅、锌冶炼项目，以及铬盐、氰化物生产项目等。

　　近年来因建设项目环境问题引发的环境群体性事件频繁发生，环境影响评价越来越受公众关注。

　　《指南》从四个方面加大了环评信息公开力度：一是公开环评报告书（表）全本，使公众能够获得环评文件的全部信息，有利于在项目审查过程中更充分地征求公众意见，接受社会监督。二是公开政府承诺文件，使公众能够对政府兑现承诺情况实施社会监督，更好地约束政府履行职责。三是公开批准和不予批准环评文件的全文。四是公开环评机构和从业人员诚信信息。

　　环保部强调，对存在重大环境违法行为的建设项目要及时调查取证或处罚；对未达到环评批复要求、公众意见集中强烈的建设项目，在整改到位之前一律不予通过环保验收。

　　据了解，环保部下一步在下放审批权限和加强监督管理的同时，将继续推进职能转变，全面提高战略和规划环评的地位和效能，增强环境保护参与综合决策能力。
