　　今天上午开始庭审中，刘光嘉、朱荣周夫妇并没有出现，其子出庭。原告诉称，其在闵行颛桥安乐村潘家34号拥有582平方米的宅基地，并依法承包了相邻的4800平方米鱼塘。刘光嘉在鱼塘上修建了私人盆景奇石博物馆。

　　被告辩称，其对原告组织实施强制执行缘于原告拒不履行法律义务，原告扩占鱼塘，即“博物馆”，范围亦属于生效法律文书所确定的拆迁补偿范围，被告对原告组织实施强制搬迁行为并未违法，且具合理性和适当性。同时，原告国家赔偿诉请并无法律基础。

　　据悉，庭审将持续2日。
