辽宁省去年5月公布《辽宁省环境空气质量考核暂行办法》，首次确立了对下级城市空气质量超标后的处罚机制，到今年10月底，辽宁省已经对8个城市开出罚单，罚缴总计5420万元，其中，沈阳3460万元，大连160万元，鞍山780万元，抚顺160万元，本溪20万元，营口40万元，辽阳500万元，葫芦岛300万元。辽宁省环保厅表示，罚缴资金将全部用于蓝天工程治理环境空气质量。
根据考核暂行办法，对下级城市进行考核的是辽宁省环保厅，辽宁省环保厅收集各市空气质量监测数据，每月按日对各市进行考核。辽宁省财政厅则负责罚缴资金的扣除，直接从下级城市财政资金中扣缴。
考核指标不含PM2.5
考核指标暂定为二氧化硫、二氧化氮和可吸入颗粒物(PM10)这三项旧的空气质量标准的指标，按照旧的空气质量标准的二级标准日平均浓度值按日考核。
今年年初，全国74个城市首先开始实施新的空气质量标准，指标变成六项，其中包括了引人关注的PM2.5，但辽宁除沈阳和大连外，其他城市还处于标准过渡期，因此沿用老标准。
根据考核暂行办法，三项污染物中每天有一项超标的，将给予黄色通报，如果二氧化硫或二氧化氮日超标0.25倍以上，或者PM10日均浓度超标0.5倍以上，将给予红色通报，有关城市需制定整改措施，限期进行整改，并受到相应惩处。
“这也是一种经济手段，推动环境治理，比行政命令好一点。”环保部环境政策研究中心主任夏光评价道。
湖北省统计局副局长叶青认为，到目前为止，通常都是企业违规排放，政府对企业追究责任，如果罚政府，就要看罚的是哪块的财政资金。
“不能减少用于民生的资金，如果称为罚款的话，只能从行政经费里扣，这才会让政府感到心痛，才会起到效果。”叶青说。

“罚款用于被罚城市大气治理”
辽宁首开“雾霾罚单”引发关注，新京报记者独家对话辽宁省环保厅厅长朱京海，他就政策出台、政策执行及环境治理等方面详细作了说明。
明年PM2.5进考核指标
新京报：处罚由哪个部门负责？
朱京海：这是经辽宁省政府同意，由省环保厅和财政厅联合操作的。我们根据空气质量标准，对每日监测结果进行汇总、考核，罚款由省财政厅直接从下级政府的财政资金中扣除。
我们监测的是日均值，每个月有多少天不达标，每天超标多少，最后累加起来，按月扣除。
新京报：目前有的城市已开始实施新的空气质量标准，为何辽宁沿用老标准？
朱京海：虽然沈阳和大连用的是新标准，但其他城市还是老标准。用新标准的城市今年还没把PM2.5算上，先过渡一年，明年就要把PM2.5也算进去了，逐步加大力度，一下子上太狠也不行，得给下级城市一点整治的时间。

新京报：罚缴资金用在什么地方？
朱京海：在“大气十条”之前，去年6月份，辽宁就启动了蓝天工程，全省一共5800多个项目，一共要2100亿元来做。罚缴资金将用于蓝天工程治理，相比总额，罚来的钱还是小数目，但它可以推动各地把大气污染治理摆上日程，在原有方案基础上再加深加宽加严，增加了地方政府的责任。
目前的罚金是算到今年10月份的，11、12月的还没算进来，而这两个月辽宁的空气污染比较严重，因为11月份开始供暖，污染物排放量加大。估计要加上11月和12月，最后的数字可能在七八千万。
新京报：辽宁的城市一般达标率是多少？
朱京海：从老标准来看，达标率已经很高了。从新标准来看，全国74个重点城市，1到10月份，全国平均达标率是58%，沈阳是63%，大连是81%。11月份开始供暖，全国达标率降到52%，沈阳是62%，大连是79%，跟全国比还算可以的。
北方城市供暖期对大气污染的影响很大，前段时间东北大范围雾霾，目前看很大程度上就是首日供暖带来的，所以我们很重视首个供暖月，这个控制好了，起的作用就很大。
那次东北雾霾时，全省总动员采取了抗击雾霾行动，省长给地方一把手写亲笔信，要求把雾霾堵在铁岭以北，现在看这种提前采取措施，全省区域化的行动起到了效果，沈阳PM2.5涨到270的时候开始出现拐点，下降了。
地方城市对政策意见非常大
新京报：类似处罚措施是否是第一次？
朱京海：之前在治水上有过类似的办法。辽河治理去年摘掉了重度污染的帽子，得到了认可，很重要的一个措施就是采取了断面补偿办法，实际上也是罚款，就是对每个城市，每个县河流的断面进行监测，如果超标，就要财政扣钱，罚款用于补偿受污染的下游。
新京报：地方上有抱怨吗？
朱京海：地方上何止是抱怨，它们对环保厅的意见非常大。之前断面补偿办法的时候，就有很多反对的声音，包括省政府、环保厅的压力都特别大，不过，最终还是把辽河的水治好了。大气的问题也一样，也有很多反对意见。很重要的一个反对意见是说，污染物外省来得很多，怎么办？我们强调先别管外省，先把自己的治好。
新京报：罚款扣除的是政府财政资金，这是来自纳税人的钱，法理上是否合适？
朱京海：作为省一级政府，很重要的职能就是监督各级政府是否负起了环境管理的责任。另外，大气也好，水也好，污染物排出去影响公众，用纳税人的钱用于公共的环境治理，这是合法的，创造良好的环境是公共财政应该承担的责任。
所以，对于水这块，排出污染物，就由上游城市“补偿”下游。对于大气，我们的原则就是，扣缴的罚款，用于被罚的城市，但要用在大气治理上。 新京报记者 金煜
