深圳市大鹏新区大鹏办事处党工委原委员、规划土地监察队原队长张某坤受贿案，一审昨日在福田法院开庭审理。检方指控张某坤利用其查违的权力，收受多人给予的61.3万元行贿款，放任大鹏街道办辖区临海的罗香园公寓别墅违建群、较场尾违建楼以及某邦传媒公司违建群的建设。不过，庭上张某坤只承认有4万元为行贿款，其他均属过年过节的礼金。
东窗事发别墅违建群将执法队长拉下马
张某坤在今年4月12日被刑事拘留。他从2009年9月到2013年案发时，一直担任大鹏办事处党工委委员、大鹏规划土地监察队队长一职，负责查违工作。张某坤在庭上已经知道，他是因为罗香园违建群而被市监察局查处的。
事发地位于大鹏海边区域，占地面积约为1万平方米。检方指控，2011年下半年，一名张姓商人经当地社区人员介绍结识张某坤，提出该地块是集体土地，社区与人合作在地块上建设公寓以及别墅。别墅开建之后，监察队曾前往查处，拆除钢筋模板。张姓商人为求张某坤手下留情，送给他5万元。此后，该违建工地继续开工。
据检方指控，就在2011年年底，深圳市土地监察支队巡查组在当地巡查时，发现这一大型违建群，要求当地立案查处。张姓商人遂找到张某坤，提出能否帮助疏通关系，进行罚款处理，不将建筑没收。
张姓商人给了张某坤10万元。张某坤此后也向巡查组表示，该处建筑物系社区所建，街道办对于该违建群的意见是进行罚款，不要没收。该建议被巡查组拒绝。张某坤因此将10万元退给张姓商人。
2012年3月，大鹏土地监察部门按规定对该违建群进行没收处罚，不过仍留下海边别墅未作处理。
为保住海边别墅，张姓商人找张某坤及时任大鹏规划土地监察队副队长协调。张姓商人认为该副队长不好说话，因此托张某坤转交5万元给该副队长。这名副队长此后将5万元款项退回给张某坤，张某坤予以截留。
大鹏街道办对于该违建群的暧昧处理，最终导致市监察局责任倒查，张某坤也因此而落马。
据张某坤称，这名张姓商人为大鹏某商会一主要负责人的弟弟，其也成为张某坤的重要行贿人。除了前述行贿款，这名张姓商人此后还因为某公司大门改建等问题向张某坤行贿。共计行贿额被检方认定为25万元。
庭审自辩庭上大吐查违“苦水”
张某坤昨日在庭上只承认4万元为行贿款，其他均为过年往来，并称前述行贿者中有不少是商人，热衷于结交官员，在过年过节时均会向官员送个小红包。讲到查建的难处时，张某坤情绪一度失控。他认为，一些大型违建被政府支持，有领导在背后撑腰，他没有能力查处。一部分困难群众为自身住房需要所建的房子，他们在查处现场都落泪，不忍心查处。
被控罪行
检方指控涉嫌收受61万元
除收受张姓商人25万元外，据检方指控，张某坤接受其他8人行贿，共收受61.3万元。
●收受张姓商人25万元。
●收受深圳鹏某生公司董事长陈某生7万元。这其中有1万元为维持关系所送，还有6万元则因为陈某生为顺利违法将大鹏滨海阳光小区改造为酒店所送。
●收受大鹏较场尾两名违建业主两栋楼共计5万元款项。
●收受大鹏街道办内某邦传媒公司6万元，帮助该公司利用旧厂房建设影视基地。
●收受豪宅别墅区大鹏山庄董事长叶某生2万元，允许别墅业主违法装修。
●收受王母河边一公司3.3万元，允许该公司自行在王母河上架桥，与大鹏主干道迎宾路连接起来。
●大鹏曼某酒店违法改造卡拉O K厅，张某坤从中收取2万元。
●一包工头占用国有土地堆放工程设备，张某坤亦从中收钱。
