  月嫂每月应休息四天


  昨日,记者从广州市工商局获悉,广州市工商行政管理局会同广州家庭服务业协会共同研究制定了2013版《广州市家政服务合同》和《广州市母婴护理(月嫂)服务合同》示范文本,修改部分实践操作中易引起纠纷的条款,并于即日起在全市推行使用。


  据悉,此次,新版家政服务合同和月嫂服务合同首次对家政投保金额、月嫂每月工作天数作出规定,对家政服务双方权益“双保险”,其中,合同规定,最低5万最高20万的意外险及保障雇主权益的服务责任险需明文显示投保保额,月嫂每月工作26天应有4天可调配假期。


  对此,广州家庭服务业协会秘书长莫晓英表示,此前,旧合同条款只规定了购买保险的档次,在家政人员服务出现意外时难以确定赔偿;且并未明文规定月嫂工作天数。“保险保额的规定,不仅保护了家政人员的权益,也保护了雇主。家政人员服务出现意外都可以由保险公司赔偿。以往的档次很难确定赔偿,而现在明确了保额,在事前双方协定好,对雇佣双方的权益保障更有利。而在休息日方面,新版合同则明确了每周休息1天和月底合同结束前休4天两种方式,双方可二选一,计算日薪时也不必因为30天还是26天出现纠纷。”


  节假日休息则顺延工作日

  昨日,广州市工商局相关负责人针对合同条款解释为,“例如,雇主与家政企业签订月嫂服务合同,服务时间一个月,月嫂工资6000元,若明年1月15日上岗。因服务时间跨明年春节,有3天国家节假期,如果雇主要求月嫂在这3天里都工作,则雇主每天要支付月嫂日工资的3倍报酬,日工资为6000元除以26天;如果雇主让月嫂在这3天放假,则月嫂应在月底顺延工作3天,保证月服务工作日达到26天。”


  3倍日工资不会催高月嫂价格


  “逢国家节假日涨至3倍日工资并不是涨价,也更不会催高月嫂工资,而是为保障月嫂权益,使得家政服务行业这与《劳动法》的相关规定进一步接轨。权利与义务对等,月嫂也有放假的权益,当雇主需要月嫂付出额外劳动的时候,可以协商进行补偿。”广州家庭服务业协会秘书长莫晓英表示。


  春节将至,国家节假日三倍日工资是否会给雇主带来经济压力?对此,市民李女士表示并未受太大影响,“过节我们都会给月嫂放假,如果的确需要留她也会提前商量好,给予双薪或者礼物等补偿。因此,若仅仅节假日那几天的3倍日工资也不会造成压力。”
