Han Shuming indecent video-related officials in Chongqing jailed 14 4.43 million in bribes

　　中新网重庆12月13日电 (记者 刘贤) 重庆市第一中级人民法院向记者证实，继重庆市北碚区原区委书记雷政富之后，重庆市另一名涉不雅视频官员、长寿区原区长韩树明13日在该院以受贿罪一审判处有期徒刑14年，剥夺政治权利4年，并处没收个人财产40万元。

　　经审理查明，2001年下半年至2013年，被告人韩树明利用其先后担任重庆市江北区委副书记、合川区区长、长寿区区长等职务上的便利，为江某承接土地整治工程等方面提供帮助，先后21次收受江某给予的财物折合人民币共计352万余元。

　　另查明，2004年初至2011年间，李某某通过被告人冯炳辉向韩树明请托在承揽工程上提供帮助，并承诺好处费，韩树明表示同意，遂利用其职务上的便利，为李某某承接工程提供帮助，并先后9次与冯炳辉共同收受李某某给予的人民币共计90万余元。

　　法院审理认为，被告人韩树明身为国家工作人员，利用其职务便利，单独或伙同被告人冯炳辉非法收受他人财物共计折合人民币443万余元，为他人谋取利益，其行为已构成受贿罪，依法应予惩处。被告人冯炳辉伙同韩树明共同利用韩树明的职权，为他人谋取利益，非法收受他人财物共计人民币90万余元，其行为也已构成受贿罪，应追究其法律责任。

　　法院认为，在共同受贿犯罪中，韩树明利用其国家工作人员职务上的便利，为他人在承接工程等方面提供帮助，起主要作用，系主犯，依法应对其参与或组织、指挥的全部犯罪予以处罚。鉴于其案发后，能够如实供述罪行，且退出绝大部分赃款等，依法可对其从轻处罚。冯炳辉伙同韩树明共同利用韩树明的职权，为他人谋取利益，非法收受他人财物共计人民币90万余元，在共同犯罪中起次要作用，系从犯，依法可对其减轻处罚。案发后，被告人冯炳辉能如实供述罪行等，依法可对其从轻处罚。

　　据此，法院一审判决，韩树明因受贿罪被判处有期徒刑14年，剥夺政治权利4年，并处没收个人财产40万元；被告人冯炳辉因受贿罪被判处有期徒刑5年，并处没收个人财产5万元；同时，对二人犯罪所得赃款443万余元予以追缴，上缴国库。
