  针对这些社会热议,国土资源部副部长胡存智昨天(12日)接受了中央台记者冯会玲的专访,对上述问题逐一讲解澄清。


  十八届三中全会决定提出:允许农村集体经营性建设用地出让、租赁、入股,实行与国有土地同等入市、同权同价。对此有人解读为,这是城市土地不够用了,要用农村的土地作为补充。胡存智对此特别强调,包括农村宅基地在内的农村土地管理制度改革,将牢牢坚持集体所有制、用途管制、城乡统筹、维护农民土地权益四大原则,宅基地制度改革的前提是要保护农民利益。


  胡存智:改革的根本目的是为了探索增加农民财产性收入的路子,不是为了解决建设用地指标,也不是为了满足城里建设用地的需要,这些改革根本的出发点是要保护农民,维护农民的土地权益,要使农民宅基地的权益得到切实的保护。


  《决定》明确提出“保障农户宅基地用益物权”,胡存智说,用益物权在物权法里是指对土地的占有、使用和收益的权利,而目前农村宅基地的收益体现得还远远不够。


  胡存智:宅基地的用益物权上保障不足和权能不足并存。一方面,宅基地目前作为农民所使用的重要土地,实际上权能还是还不够的,他目前只有使用权利,也出现一些超越权能的问题,比如乱出租、违章搭盖等。也存在着在一些征地过程中,对农民宅基地用益物权保障不够、补偿不足等。下一步对宅基地的改革和推动是让宅基地在使用益物权上扩大权能,能够赋予更多的权能,把它用好,使农民在宅基地上能够探索出一条获得更多财产性收益的路子。


  国土资源部执法监察情况显示,农村宅基地的违法违规很长一段时间都呈现多发态势,以2010年土地卫片执法检查为例,广西、贵州、甘肃等地农民建房违法用地,宗数比例高达50-80%,但面积只占全部违法用地面积的15%-20%。胡存智坦言,目前农村宅基地确实存在多种问题亟待解决。


  胡存智:规划不够落实,所以农村宅基地的布局上比较散乱,有关的计划上落实不够,分配上得不到及时保障。在使用上诸方利用,一户多宅、超标使用这些普遍存在。退出机制还不健全,形成比较大量的空心村、闲置地。


  针对目前宅基地存在的问题,胡存智透露,国土资源部将会出台措施确保宅基地分配发放应保尽保。


  胡存智:目前,国土资源部在每年建设用地指标的使用,上明确要求各地宅基地建设要有一定的倾斜和保障,不能低于5%的比例,最近我们也在研究,也在准备制定出台措施对宅基地的分配发放做到应保尽保,在考虑采用先用后核销的办法来保证宅基地的分配和发放问题。


  《决定》还提出,要“选择若干地区试点,慎重稳妥推进农民住房财产抵押、担保、转让”,对此有人认为,这意味着城里人也可以到农村购买宅基地。胡存智强调,这是对政策的误读。


  胡存智:农村的宅基地是本集体经济组织农民所分配使用建房子的土地,也就是说法律规定宅基地的取得是和本集体经济组织的成员是密切关联的,只有你是本集体经济组织的人才能使用这块宅基地,所以无论是购买或是以其他方式使用农村宅基地,这是违反法律规定的,不受法律保护。


  截止2012年年底,国土资源部对农村集体土地的确权登记已基本完成,农村集体土地登记颁证率达到97%,今年又全面开展了对农村宅基地和集体建设用地的确权登记颁证工作。胡存智说,这些工作也都是希望能够更好维护农民利益。


  胡存智:具体落实到每一块地、每一宗宅基地上,通过确权登记颁证把农村的建设用地和宅基地进行完整的产权确认,这样为宅基地的管理和宅基地的用益物权保障奠定好基础。目前,这项工作已经在全国各省普遍的开展起来,计划用三年时间完成这项工作。
