“武疯子”，是指具有暴力倾向、人身危险性较大的精神病人。据不完全统计，我国约有16000名暴力犯罪精神病人。我国相关立法先后作出规定，可对这些人实行强制治疗。
浙江建德23岁的程某就是个武疯子。早在2008年，程某被查出患有精神分裂症。之后，他一直由外婆负责照料生活。
今年6月，外婆给程某喂药时，程某又嚷嚷起来，说外婆给喂的是毒药，坚决不吃。因此发生激烈的冲突，程某一怒之下遂锁上大门，拿起菜刀砍死外婆。
经鉴定，程某患有精神分裂症，实施上述行为时处于发病期，被评定为无刑事责任能力，因而不会因为杀死外婆而坐牢。
但法院认为，程某有继续危害社会的可能，所以作出了对程某强制医疗的决定。
就拿起菜刀砍死外婆。面对一个精神病人，法院不能科以刑罚，但浙江省建德市人民法院日前作出一份强制医疗决定书，对“武疯子”程某强制医疗。
为保护社会免受精神病人侵害，也使精神病人得到妥善治疗，今年开始施行的新刑事诉讼法新增了“对依法不负刑事责任的精神病人的强制医疗程序”。
截至目前，浙江法院共收到检察机关提起的强制医疗申请案件37件，已审结35件，均作出了强制医疗决定。另还收到精神病人家属提起的解除强制医疗申请案件1件，法院决定解除。
浙江高院刑三庭庭长丁卫强介绍，分析审结的35起案件有三个特点：一是暴力行为严重危害人身安全(所谓“武疯子”行凶)的情况突出。其中，杀人或者故意伤害致死人命的13件，占37.1%；致人重伤的8件，占22.9%；致人轻伤的6件，占17.1%；其他如放火、持刀抢劫、伤害并妨害公务的8件，占23.5%。
二是精神病人亲属的人身安全受到危害的情况较多。共有12件，占34.3%，其中被杀死或者被故意伤害致死的8件。
三是被鉴定为精神分裂症的比例很高。在决定予以强制医疗的35人中，有25人被鉴定为精神分裂症，占71.4%。其他的还存在如癔症性精神障碍、待分类器质性精神障碍、酒精所致的精神和行为障碍、躁狂症等精神病类型。
“新刑事诉讼法实施以前，对于一些‘武疯子’伤害他人的案件，由于大多数精神病患者家庭贫困，监护人根本无力看管或对其医疗。现在由政府对其强制医疗，这既是预防和减少精神病人危害社会安全举措，也是对特殊群体的关照。”承办程某案的法官说。(完)
