新京报讯 私装地锁谁来管？怎么罚？昨天有了明确说法。将于明年1月1日起施行的《北京市机动车停车管理办法》(下称《办法》)规定，擅自在道路、居住区以外的其他公共场所，如胡同设置地桩、地锁等障碍物的，由城市管理综合执法部门责令停止违法行为，恢复原状，并处500元以上5000元以下罚款。
该《办法》还对北京市的停车场建设、日常运营、管理等进行了规范。
停车场车位数今后能实时了解
昨日发布的《办法》首次将停车定义为交通体系的一部分，让停车场终于找到了主管“娘家”。《办法》明确，今后由市交通行政主管部门主管全市的停车管理工作。
如何保证司机都能找到车位停车？根据《办法》，任何单位和个人不得擅自停止使用停车场，不得将停车场改作他用。中心城范围内的停车场向社会开放并收费的，应当24小时开放；按照规定实行限时的临时停车场除外。
《办法》还要求建立统一的停车场信息管理和发布系统，对停车泊位进行编号，对停车场信息实行动态管理，并实时公布向社会开放的停车场分布位置、使用状况、泊位数量等情况。这意味着，以后车主可实时了解周边停车场的车位情况。
小区里私自装地锁最高罚1万元

“黑停车位”罚金提至1万
该《办法》同时对“黑停车场”和“冒牌停车管理员”的违法行为进行界定。停车场向社会开放并收费的，停车场管理单位应当依法办理工商登记、税务登记、价格核定、明码标价牌编号等手续，在工商登记后15日内到区、县停车管理部门办理备案。停车场管理单位未按照规定对停车泊位进行备案的，由城市管理综合执法部门处1万元罚款。
市交通委运管局相关部门负责人解释，原办法对停车泊位未备案的停车场管理单位处以2000元以上1万元以下罚款，此次新办法取消了城管部门自由裁量的规定，统一规定处罚1万元，加大处罚力度。
此外，如果停车场或者停车管理员存在扰乱公共秩序、招摇撞骗、诈骗、妨碍公务等违反治安管理的行为的，由公安机关依照《中华人民共和国治安管理处罚法》予以处理；构成犯罪的，依法追究刑事责任。这就意味着，“黑收费员”被查会被处以治安拘留处罚。去年，已经有多名“黑收费员”被司法机关依法追究刑事责任。北京市交通委运输管理局透露，力争到明年底，将二环内“黑停车场”全部取缔，并逐渐向三环、四环推进打击。
新建小区停车场须同步交付

《办法》明确规定，新建、改建、扩建公共建筑、居住区等，应当按照国家和本市有关规定和规划指标，配建机动车停车场。
机动车停车的配建标准也将改变。目前，规划部门正在制定新标准。新标准出台后，新建居住区停车位缺口将基本堵住，基本按照一户一车位配比。
《办法》要求，配套建设的停车场应当与主体工程同步设计、同步施工、同时验收、同时交付使用。
《办法》还鼓励单位和居住区在满足本单位、本居住区居民停车需求的情况下，将配建停车场向社会开放，同时可以按照核定的价格对社会车辆收取停车费。
对于配建的停车场不能满足业主停车需求的，《办法》规定，可以统筹利用业主共有场地设置临时停车场；居住区不具备场地条件的，可以在居住区周边街坊路或者胡同设置临时停车场；还不能满足的话，区、县人民政府可以组织相关单位利用待建土地、空闲厂区、边角空地等场所，设置临时停车场。
小区居民凭有效证明在临时停车场停车时，其临时停放或按月、按年租用停车位收费标准，按照居住区露天停车场收费标准执行。根据《北京市居住区机动车停放收费管理办法》，小型车露天临时停放收费标准为每小时0.5元，露天长期停放收费标准为每个月150元。
停车场“打折”停车将被罚
北京市按照区域差别化停车收费也纳入《办法》中，今后北京市的停车收费遵循城市中心区域高于外围区域、道路停车高于路外停车的原则。
向社会开放的停车场需要在显著位置明示停车场名称、服务项目、收费标准、车位数量以及监督电话。部分停车场私自通过“包价”或者降价招揽生意的行为，明年也将被明令禁止。必须按照额定价格收费，不得提高收费、不得降低收费，并向停车人出具发票。
停车场管理单位未明码标价、擅自提高或者降低收费标准的，由发展改革行政主管部门依法处理。
此外，市交通行政主管部门和区、县停车管理部门应当对向社会开放的停车场的运营服务实行质量信誉考核，考核结果向社会公布。
公安机关交通管理部门则可以根据道路交通状况、周边停车需求情况，在城市道路上依法设置和调整道路停车泊位，并予以公示。
