没有办理合法手续，仅凭两个政府会议纪要，一个原政府棚户改造项目擅自开工，准备建成一个百米高的商住大厦。虽然当地规划、国土等多部门已先后下发了数道停工通知书，但这个违法建筑依然还在热火朝天地开工。
近日，湖南省邵阳市一些市民投诉称，该市中心城区出现了这样一个“最牛违法建筑”。接到投诉后，记者赶往邵阳实地进行了调查。

棚户改造违法改建商住大厦
在邵阳市大祥区红旗路立新街和曹婆井的交汇处，记者看到一个巨大的工地被蓝色挡板围了起来，里面有十来个工人正在进行深坑作业，一台高大的塔吊吊臂在工地上空来回穿梭，现场很是热闹。
“按照目前的搞法，这个高楼一旦建成，物资局家属院30多户北向将没有出路，只有南向1.4米小巷进出，内无任何消防设施，一旦发生火灾，后果不堪设想。”居民莫女士告诉记者，因担心项目对居住环境的消极影响，包括邵阳市财委家属院20多户在内的诸多居民曾多次要求查看项目的手续资料，但美利亚公司只是把一些政府会议纪要与领导批示拿出来，甚至一度贴在墙上，说这就是他们的“法律”。
“该项目楼层设计高度100米，房屋基础座落紧靠百货站和万里公司，没有留出标准的建筑间距。这个违法项目一旦建成，将直接侵害万里公司和百货站的建筑间距。”紧靠工地的邵阳市百货站下岗职工徐大姐告诉记者，如今百货站的土地正在准备开发，这个项目建成将有可能影响今后其他项目的落地。
“这个项目开工以来，邵阳市国土、城管等部门已连续下发了多次停工通知，甚至罚了款，但就是制止不了。”同样担心该项目建设对自己即将进行的邵阳市政府重点项目——豪布斯卡中央广场造成影响的邵阳市万里百货有限公司有关负责人雷吉泉介绍说，目前邵阳市政府正在发起一场声势浩大的拆违运动，墙壁上到处贴着违法建筑就是犯罪、要坚决依法打击、依法拆除等标语，但这个建筑就是安然无恙。

多部门证实项目确无合法手续
“目前邵阳市美利亚房地产开发有限公司在立新街正在开工建设的宝圆丽都项目，还没有进规划部门的窗口，也没有办理合法的手续。从本质上来讲，这属于违法建筑。”邵阳市规划局用地科科长陈建邦告诉记者，这个建设项目还没有取得建设工程规划许可证，其处罚处置情况属于城管和控违办等部门管辖。
“到目前为止，宝圆丽都项目是一个典型的违法建筑。”邵阳市大祥区城管局党组书记、大祥区控违办专职副主任申斌华告诉记者，从2012年7月开始，美利亚房地产公司的宝圆丽都项目就陆续被人举报为违法建筑。城管局安排队员立案调查后发现该项目没有取得任何合法手续，也没有向他们提供任何手续。对此，大祥区控违办已连续下了多份停工通知书，但每次都是在当时停上一两个小时，多则一两天，随后很快又继续开工。
申斌华表示，按照目前的制度设计，对于那些下了停工通知书后依然动工建设的，城管只能向有关部门申请采取停水停电停气等措施，手段相对有限。目前区控违办正和邵阳市经信委等联系，准备对该工地停电。虽然还有一个查封施工现场的处置措施，但这个权限在市政府，需要审批。由于此前还没有先例，他们也不知道具体怎么操作。
“到目前为止，宝圆丽都这个项目没有在邵阳国土部门办理任何有效的土地登记与审批手续。”邵阳市国土局副局长杨跃荣在接受记者采访时同样明确表示，此前国土部门对其也发出了停工通知书。
采访中，记者看到了一些分别由邵阳市国土局、大祥区控违办、邵阳市城管局、邵阳市建设市场执法监察支队等部门对美利亚房地产非法修建宝圆丽都大厦下发的停工通知书，其中有三份是11月26日、28日、30日连续下发的，此前不同时间段的都有。
“我们不是不想办手续，是有关部门一直不给我们办理。”美利亚公司副经理李千载对记者说，当初为安置立新街的一些棚户改造拆迁户，邵阳市政府先后开了多次会并形成了两个政府会议纪要，要求公司接盘这个项目。如今公司已先后投入了7000多万元资金及大量人力物力，但后来这块土地周边又准备兴建另外一个政府重点项目——豪布斯卡中央广场，国土出让手续会审一直没有结论，导致项目其他手续也就无法办理。为此，11月27日公司给邵阳市政府递交了一份《请求批准红旗路立新街棚户改造项目第一期安置房工程边施工边办理建设手续的报告》，但政府并没答复。
美利亚公司经理陈克琦在接受记者采访时则情绪激动地表示，之所以会出现今天这种“一女二嫁”的局面，某些随意批示的市领导对此要负主要责任。目前建设项目确实没有有效手续，但工已无法停下来，因为此前已签了协议的112户拆迁户经常会过来督促工期，并派了代表整天蹲守在工地上，只要一停工这些人就会到处闹事信访，对此公司也没有办法，只有继续开工。
就在记者采访的当天，虽然邵阳市有关领导明确表示工地要立即停工，但这次依然只是在下午停了几个小时，第二天早上不仅又开始了施工，而且施工人员的规模、数量和开工量明显比以前有了增加。
质疑
多部门为何停不了违法建筑的工
“对违法建设，建设部门要对其施工单位进行查处，工商、卫生、文体、税务、环保等部门不得办理有关行政许可证件，公用事业、电业等部门不得办理供水供气供电报装手续，规划、城管部门不得实行‘以罚代法’或‘先上车、后补票’，房产、国土部门不得办理产权证和土地使用证。”采访中，记者看到了一份名为《邵阳市人民政府关于加强城区违法建设监管工作的意见》的文件。这份由邵阳市政府2010年3月30日签发的文件明确提出，要建立日常的巡查制度，实施“动态拆除”，从源头上遏制违法建设行为。对在建违法建设项目由乡镇(街道办)组织相关单位当场发现当场拆除，及时制止。乡镇(街道办)强制拆除有难度的，在两个工作日内报区政府组织强制拆除。
此外，文件还规定，要将违法建设监管工作纳入市政府督查事项，市政府督查室、市政府城市化办和市监察部门要全程跟踪督办违法建设监管推进落实情况；对违法建设监管工作推进情况，要依据职责严格实行绩效评估和行政问责制度。
“目前邵阳正在全面清理整治违法建筑，相关制度规定也十分明确，可为什么宝圆丽都这种没有任何手续的违法建筑，这么多的部门就是停不了它的工？难道非要等到违法建筑建成百米高楼后再去耗费大量人力物力拆除吗？”对此，居民王先生很是不解。
“一个以政府棚户区改造名义进行的项目，没有办理合法手续就准备建成一个百米高商住大厦，这不仅是违法建筑的问题，而且涉嫌利用国家棚户改造政策非法牟利。”邵阳市民朱先生认为，无论是这个“最牛违法建筑”的出现，还是如今的“变身”，背后可能存在某些权钱交易的因素，建议纪检部门介入调查。
“如果对于违法建筑的存在和出现，国土、城管等多部门仅仅只是下发停工通知书，而不能采取更多更有效的措施，那么，势必会导致更多违法建筑的出现和泛滥，从而冲击社会对法治的信仰，削弱民众对政府公权的尊重。”12月16日上午，中南大学法学院副院长陈云良在接受《法制日报》记者采访时明确表示，无论是领导批示还是政府会议纪要，都不能替代和超越现有的法律制度，更不能成为违法建筑存在和出现的理由。
“下发停工通知书后如果继续违法施工，规划、建设、城管等部门还可依法采取查封施工现场、强制拆除等多种强制措施。”对于如今多部门数道停工通知书就是阻挡不了违法建筑开工步伐的情况，陈云良认为，关键还是需要邵阳市政府及相关部门态度鲜明，执法必严、违法必究，及时采取更为有效、有力的措施，坚决叫停；否则就是对违法行为的纵容，就是一种行政不作为。
