新京报讯 (记者张媛)因申请公开指定“生乳”等66项食品安全国标的《会议纪要》遭拒，郑州消费者赵正军将国家卫计委告上法庭。
昨日，北京一中院公开审理并当庭驳回了赵正军的诉讼请求。
消费者申请公开遭拒
2010年，原卫生部(现国家卫计委)公布了新修订的生乳标准，新标准中蛋白质含量远低于发达国家3克以上的标准，而菌落总数放宽数倍后，是美国、欧盟标准的20倍。
从2011年12月开始，赵正军向原卫生部提出信息公开申请，要求重点公开生乳新国标制定会议纪要。遭拒后，赵正军将原卫生部诉至北京一中院。法院一审判决原卫生部撤销作出的《非本机关政府信息告知书》，在法定期限内对原告的政府信息公开申请予以重新答复。
之后，原卫生部答复认为，赵正军申请的信息是过程性信息，不属于公开范围。
赵正军不服，再次向北京一中院提起行政诉讼。其间，被告原卫生部变更为卫计委。
被告拒绝公开讨论信息
昨天庭上，赵正军表示，根据《政府信息公开条例》，他申请的《会议纪要》不属于国家秘密、商业秘密和个人隐私的不予公开情形，也没有证据证明会议纪要属于处于审议、讨论过程中的信息，因此其有权知道这一标准如何出炉的，有权要求重新制定。
卫计委表示，行政机关在日常工作中制作或获取的内部管理信息及处于讨论、研究或审查中的过程性信息，一般不属《条例》所指应公开的政府信息。另外，本案中最终信息“生乳”标准已公开。
原告表示上诉
法庭休庭15分钟后，作出判决称，根据《政府信息公开条例》，将行政决策过程中的政府信息均排除于公开范围之外没有法律依据。而另一方面，行政机关在行政决策作出前能够充分汇集不同观点，从而保证行政决策的正确作出，对实现“提高政府工作的透明度，促进依法行政”同样具有重要意义。经权衡，法院认为，对于在行政机关内部交换意见的政府信息，无论在行政决策过程中公开，还是在行政决策作出后公开，均可能导致在行政机关内部难以坦率地表达意见，故此类政府信息应免于公开，一审判决驳回赵正军的诉求。
赵先生表示要上诉。
