  央广网银川12月17日消息(记者许新霞)宁夏回族自治区人民政府日前审议通过了《宁夏回族自治区实施〈国有土地上房屋征收与补偿条例〉办法(草案)》(以下简称《办法》),《办法》规定:今后,在宁夏范围内,任何单位和个人不得采取暴力、威胁或者违反规定中断供水、供热、供气、供电和道路通行等非法方式迫使被征收人搬迁。同时,禁止建设单位参与搬迁活动,房屋征收应当先补偿、后搬迁。


  《办法》统筹兼顾了公共利益和被征收人合法权益。明确市、县人民政府应当组织有关部门,依据国民经济和社会发展规划、土地利用总体规划、城乡规划制定房屋征收年度计划。房屋征收年度计划、征收补偿方案应当公开征求社会意见,并根据征求意见进行调整和修改。因旧城区改建需要征收房屋,被征收房屋范围内超过半数的被征收户认为征收补偿方案不符合相关规定的,应当组织由被征收人和公众代表参加的听证会,并根据听证会情况修改方案。市、县人民政府应当在作出房屋征收决定后5日内发布公告,并在政府网站上公示。自房屋征收决定公告发布之日起,任何单位和个人不得在房屋征收范围内新建、扩建、改建房屋,改变房屋用途,转让、租赁和抵押房屋,以被征收房屋为注册地址办理市场主体设立登记、住所(经营场所)变更登记,以及其他不当增加补偿费用的行为。


  《办法》规定,作出房屋征收决定前,征收补偿应当足额到位、专户存储、专款专用。对被征收人的补偿包括:被征收房屋价值的补偿;因征收房屋造成的搬迁、临时安置、停产停业损失的补偿。征收个人住宅,被征收人符合住房保障条件的,无需轮候,应优先给予住房保障。被征收人房屋建筑面积少于50平方米的,应当提供建筑面积不少于50平方米的成套安置房,50平方米以内的部分,被征收人不再结算差价;超过50平方米不足60平方米的部分按照成本价购买;超过60平方米部分,按照安置房市场价格购买。对被征收房屋价值的补偿,不得低于房屋征收决定公告之日被征收房屋类似房地产的市场价格。被征收人对补偿决定不服的,可以依法申请行政复议,也可以依法提起行政诉讼。


  《办法》还细化了法律责任,各级政府及部门在征收过程中出现违法违规行为的,将视情节给予通报批评、警告、罚款等处罚;构成犯罪的,依法追究刑事责任。
