捡拾弃婴不得擅自自行收养或送给他人收养
《办法》对弃婴救助管理工作中的捡拾救治、遗弃人查找、弃婴安置和资金保障等问题进行了规范，明确了各部门的职责。弃婴救助实行属地管辖、分段监护、迅速捡拾、及时救助，查找遗弃人与送养救助相结合、专门救助与社会救助相结合及“先救治、后结算”的原则。任何单位或个人发现弃婴后，要第一时间向所辖社区居民委员会或村民委员会通报，及时依法向当地公安机关报案。捡拾人或其他任何单位、个人均不得擅自将弃婴自行收养或者送给他人收养。

《办法》规定，接到报案的公安机关应当迅速将捡拾的弃婴转送当地卫生部门指定的救治医院进行观察、体检和救治，并及时出具捡拾证明、报案证明等相关材料。弃婴入院观察时间不得少于3天，观察期满且无明显病症的弃婴、经救治病情稳定的弃婴，由医院临时负责与儿童福利院联系，没有儿童福利院的与当地民政部门联系，将弃婴转入福利机构抚养，并同时通知转送的公安部门。发现已经死亡的弃婴，出警民警应直接联系殡仪馆，并出具相关证明等材料，殡仪馆应按规定接收处理。同时，各市(州)、县(区)卫生部门应在本行政区域内指定二至三家具有较强医疗技术和设备的公立医院，作为弃婴救治的定点医院，省级卫生部门确定2所医院为弃婴定点转送医院，并明确其职责、义务和救治费用承担方式。弃婴的救治费、住院费和住院期间的生活费，先由救治医院垫支；经公安机关侦查找到遗弃人的，由遗弃人承担弃婴医疗等费用，家庭确实困难的，在合作医疗报销后，由民政医疗救助资金解决；经公安机关侦查未找到遗弃人的，在医院救治弃婴产生的医疗费用，按照属地管理的原则，由当地政府财政列支，确有困难的，从城镇居民医疗保险、新型农村合作医疗和医疗救助资金中解决，按半年或一年及时与医院结算。弃婴收养机构或收养人要及时为弃婴办理参保参合有关手续。鼓励和倡导社会组织和个人爱心捐助。医院救治弃婴，不得从中盈利。
遗弃人拒绝领回弃婴或者遗弃情节严重的依法追究刑责
《办法》同时明确，弃婴自捡拾之日起，移交到哪个单位，该单位即为弃婴的临时监护责任人。对捡拾人报案后查找不到遗弃人的弃婴，公安部门应将报案材料和捡拾人的身份证明及相关的调查取证材料等随弃婴移交定点医院或儿童福利机构。弃婴主要由儿童福利机构收养，也可以由符合收养条件的公民收养，但均应依法办理收养手续，弃婴的户籍手续也要按照规定办理。各市(州)、县(区)政府应当保证由儿童福利机构收养的弃婴的基本生活经费、医疗费用和教育经费；结合各地经济社会发展的实际逐步建立自然增长机制，其保障标准不得低于我省孤儿基本生活费标准。
对于遗弃人的查处，《方法》规定，遗弃人查找工作由公安部门负责，卫生、民政、人口、宗教部门和乡、镇人民政府、街道办事处协同配合。公安部门应对查找到的遗弃人进行批评教育，责令其领回弃婴，并真心悔过；对拒绝领回弃婴或者遗弃情节严重的，应当提请司法机关依法追究刑事责任。
