案件回放 离职空姐开网店走私化妆品判11年
李晓航是海南航空公司的空姐，2008年因病离开航空公司。
2009年夏天，她和男友石海东在淘宝网上开了名叫“空姐小店”的化妆品店铺，销售化妆品。
2010年8月起，李晓航与在韩国工作的褚子乔合作。褚子乔弄到了韩国机场免税店的账号，在韩国购买化妆品，之后邮寄到中国。
一个月后，中国海关出了新政，海关将个人邮寄物品进口应征税税额起点从500元下调到50元。许多像李晓航这样的卖家，开始选择以个人携带入境的方式避税。之后的一年中，李晓航及其男友石海东通过客带货的方式从无申报通道携带化妆品入境，均未向海关申报。
2011年8月31日，李晓航从韩国到达首都机场后被抓获，后以走私普通货物罪被提起公诉。
检方指控，2010年至2011年8月，褚子乔提供韩国免税店账号并负责在韩国结算货款，李晓航伙同石海东多次在韩国免税店购买化妆品等货物，以“客带货”的方式从无申报通道携带入境，通过网店销售牟利。
检方指控的犯罪金额分为两部分，一是两次走私被当场查出的现货涉及的偷逃税款11万元，另一部分是根据淘宝网店订单推算的，数额被认定为109万元。
2012年9月3日，法院一审以走私普通货物罪判处李晓航有期徒刑11年，褚子乔有期徒刑7年，石海东有期徒刑5年。李晓航不服上诉。
2013年5月，市高院二审以“一审判决认定的事实不清、证据不足”为由，将此案发回二中院重审。
2013年10月9日，二中院第一次开庭审理。因患病被取保候审的李晓航在父母陪同下出庭，庭审主要针对海关出具的核税证明书和被告人李晓航淘宝网店订单上的货物是否全部入境进行了重新质证。
法庭上，公诉人提交了北京海关新的《海关核定证明书》，以及两份海关部门的《工作说明》。《证明书》就被查获的实物部分进行了计算，认定该部分的偷逃税款为8万。
宣判现场 走私额降低改判3年律师称上诉
上午9时30分，已被取保候审的被告人李晓航和父母相扶着出现在二中院西门外的安检室，她穿着黄色的羽绒服，戴着大口罩，眉头深锁，脚步缓慢。
除了李晓航外，她的父母也都戴着口罩，走在前边的她的母亲拄着拐杖，“前两天因为想着女儿的事我精神恍惚，所以下楼的时候摔了，脚崴了，还没好。”李晓航的母亲说。
走进安检室后，李晓航体力不支，倚靠在座位上，与前次受审时相比，李晓航显得很臃肿，“血小板老是低，只能靠药物维持，吃了大量激素，所以现在已经胖的不成样子了。”李晓航摆摆手，表示不能接受采访。
9时45分，3人相扶着走进了法院。
10点45分，李晓航的父母和律师一同走出法院，“他们把我孩子收了，她还病着呢，可让我们怎么活啊。”李晓航的母亲边哭边大声的喊着，走出法院西门，突然晕倒在地，“法院认定我孩子的走私数额是8万，以前是109万元，但是却判了3年刑。同样的案例，上海才判了一年，缓刑一年。”李晓航的父亲搀扶着老伴说。
“我们一定要上诉，判刑过重。”李晓航的律师张彦表示，二中院经过审理认定李晓航等人的走私数额从109万元降为8万，按照此罪名和涉案金额，应该判处有期徒刑3年以下，但是对李晓航确实判的太重了。
张彦还表示，目前李晓航患病，并不适合羁押，但她当庭被宣布重新收监，并已经送往看守所，她父母很是担心她的身体。“我们一定上诉到底。”
延伸采访 海外邮寄出新规造就“空姐代购”
电商领域专家、北大综合管理咨询公司高级合伙人金波表示，最初，代购有三种模式，第一类是个人去国外购物或专业的代购团队去海外购买目标性商品，运回国内后再开展业务。第二类就是个人卖家通过海外购物网站邮购回国内，再进行代购。第三类是海外卖家通过自身所处环境优势，帮国内买家代购，再邮寄给买家。

但据媒体报道，我国将入境商品区别为物品和货品，海外代购的商品具有牟利性，因此属于货物，无论金额多少，都要纳税。即便单次金额较小，但如果按累计的应缴税额计算，后果可能很严重。
行业影响 从业者：如果空姐判刑代购店主都得蹲监狱
一位海外代购店主告诉记者，如今的代购不仅在淘宝网上卖，还会在微博、微信上售卖。售卖的商品除了名包等奢侈品外，还涉及生活必需品，如奶粉、尿不湿等。
“如果李晓航被判刑，那大多数淘宝代购网店的老板都得蹲监狱。”店主表示，如果李晓航被重判，将对业内产生很大影响，对中国消费者来说是极大损失。
该人表示，国人选择代购，是认为这些商品能保证质量，且价格便宜。如一件名牌羊绒衫代购价2000元，在国内商场专柜的价格则不低于1万元。
该店主说，判决结果对海外代购店主的冲击会很大，规模小的卖家会选择退出市场。
淘宝代购店主姜小姐说，她的经营方式和李晓航类似。“‘空姐案’后我就不做了，真要被查到背上逃税的罪名，还得进监狱，不值得。”她说。
她表示，很多小型代购网店店主都是兼职，因为不靠代购吃饭，不愿铤而走险。
专家：受案件影响行业增速变缓
有媒体报道称，淘宝代购卖家有10万，化妆品代购5000多家。
据中国电子商务研究中心监测数据显示，2010年、2011年，中国海外代购市场交易规模分别达到120亿元、265亿元。《法制晚报》记者最新了解到，2012年中国海外代购市场交易规模达483亿元，较去年同比增长82%。
中国电子商务研究中心主任曹磊接受《法制晚报》记者采访时表示，中国电子商务研究中心预计2013年海外代购的交易规模将有望达744亿元。
曹磊表示，2012年的交易规模增速本来可以更快，放缓的一个很重要原因是“空姐案”的影响。
他说，据他了解，在淘宝网上从事代购行业的，游走在“灰色地带”的占很大比例。“空姐案”宣判后，很多店主纷纷改行。
