王林诉弟子返还港屋案胜诉 曾因拜师费惹争议|香港|王林|房屋_新闻资讯

  南都讯 记者刘伟 昨日上午,王林诉昔日弟子邹勇返还香港房屋一案进入执行阶段。按照香港高等法院判定,王林取得所诉物业一切所有权。该物业此前名义上一直归属邹勇,香港高等法院审理认定邹勇只是以信托形式代王林持有。


  该案是王林与邹勇之间最早结案的三起诉讼案件之一。今年7月底,“王林事件”一度闹得沸沸扬扬,邹勇以王林“关门弟子”身份对王林进行多方位揭发,二人之间的恩怨随之浮出水面。除去巨额拜师费等争议,二人之间还涉及3宗与房产有关的纠纷,其中两宗涉及深圳一处别墅,另一宗为香港北角城市花园一处价值千万的物业,即是本案所涉物业。


  邹勇早前称,该物业为其购买后赠与王林,当时是与友人将两千余万现金给予王林,让其在香港北角城市花园购买两处物业,二人各拥一套。王林称,此两处物业均是自己购买,其中一套名义上隶属邹勇,目的是帮助邹勇取得香港投资记录,以便最终取得香港永久居留权。为此,他还帮邹勇办理了冈比亚居留权。邹勇承认冈比亚居留权是王林帮助办理。


  今年7月底“王林事件”沸腾后,王林避走香港,并于8月8日委托香港梁家驹律师行向香港高等法院提出申请,要求邹勇返还北角城市花园物业。该案10月24日在香港高等法院开庭,由于邹勇没有出庭也没有委派律师出庭,香港高等法院根据王林提供的银行转账记录等出资凭证,判定王林为该物业的实益权拥有人,判令邹勇在14天内将该物业转易给王林,如果邹勇未能遵从,原告方的代理律师行的其中一位律师或香港高等法院的司法常务官则获权签署转让法律文件。


  香港梁家驹律师行执行合伙人余剑锋律师表示,案件提交香港高等法院后,律师已经按律通知邹勇要求其进行答辩,就物业产权进行必要解释,但始终没有获得反馈。邹勇对此没有置评。他此前接受南都记者采访时表示,他不知道王林在香港起诉他,他也不关心这些,“我是做实业的,哪有这么多闲工夫?”对于本次判决结果,邹勇没有接受采访。


  余剑锋律师表示,根据香港高等法院命令,他获权签署文件,将该物业转让给王林。案件目前已经进入执行阶段,王林最迟一周后即可获得该物业全部所有权。邹勇此后做法都已超法律规定时效,不再具有任何意义。


  除本宗官司外,王林与邹勇还涉及深圳一处别墅纠纷。2012年10月29日,王林向萍乡市中院提起诉讼。萍乡中院2013年5月9日一审宣判,认定原、被告的买卖房屋协议真实合法有效,因被告邹勇违反协议,遂判决解除购房合同,邹勇返还王林购房款3300万元。


  邹勇不服一审判决,上诉至江西省高级法院。2013年8月21日,江西省高院以“原审判事实不清”为由裁定发回重审。
