  国家旅游局表示,旅行社指定具体购物场所和安排另付费项目的,应当按照诚实信用、自愿平等、协商一致的原则,与旅游者订立书面合同,且不得以不合理的低价组织旅游活动,不得诱骗旅游者,不得通过指定具体购物场所和安排另行付费旅游项目获取回扣等不正当利益,也不得影响其他旅游者的行程安排。


  国家旅游局解读“指定购物”


  “以不合理的低价组织旅游活动”:旅行社以低于接待和服务费用的价格或者行业公认的合理价格提供旅游服务,且无正当理由和充分证据证明的,应认定为“以不合理的低价组织旅游活动”。


  “诱骗旅游者”:旅行社或者其从业人员通过虚假宣传,隐瞒旅游行程、具体购物场所及商品或者另行付费旅游项目等真实情况的手段,诱使旅游者参加旅游活动或者购买相关产品和服务的,应认定为“诱骗旅游者”。


  “回扣等不正当利益”:旅行社或者其从业人员违反反不正当竞争的有关规定,或者通过诱骗、强迫、变相强迫旅游者消费,收受的旅游经营者以回扣、佣金、人头费或者奖励费等各种名义给予的财物或者其他利益,应认定为“回扣等不正当利益”。


  “影响其他旅游者行程安排”:旅行社安排旅游者在指定具体购物场所或者另行付费旅游项目活动时,没有对其他不参加相关活动的旅游者作出合理的行程安排,导致其合法权益受到损害的,应认定为“影响其他旅游者行程安排”。

  “价格低于行业公认”该如何判定?


  中国社科院旅游研究中心特约研究员刘思敏上午向《法制晚报》记者表示,此次通知可看做是行业内针对《旅游法》的首个解读,有利于旅游业统一执行操作。


  不过,对于国家旅游局提出的4条要求,游客如何知道什么是“不合理低价”以及“诱骗旅游者”?


  “这连我们都不清楚。”环境国旅总裁钟晖表示,比如第1条“行业公认的合理价格”该如何界定,目前并没有具体说法,这让旅行社也不知所然。


  “目前对于指定购物提出了一个大的方向,具体的操作细则还是没有说清楚。”钟晖说。


  同时,他认为,“国家旅游局下发的通知仅能看成是行业解读,而一旦旅行社受到起诉,法院是不会根据行业解读来进行判定的,所以我们希望正式的司法解释可以尽快出台。”


  刘思敏则表示,虽然通知仅是行业解读,无法作为判断是否违法的直接法律依据,但仍可作为参考,对司法判决起到重要作用。

  可以指定购物春节出游价格会受影响吗?


  目前,正是年底及春节出游的报名高峰,一些消费者认为,既然可以在一定的前提下“指定购物”,此次国家旅游局下发的通知是否可以使得目前高涨的出游价格“降降温”?


  众信旅游相关负责人上午表示,不会出现这种情况,因为以往的指定购物都是通过“回扣”、“佣金”等方式摊平出游价格,让游客“看上去”更加便宜。


  此次下发的通知规定,虽然可以在“协商一致的前提下”指定购物,但同时规定旅行社不能以收受“回扣等不正当利益”组织购物和安排自费项目,所以价格仍然会维持现状。


  不过,对于游客希望前往的不是针对中国旅游团的当地一些大型商业街区,旅行社会更加配合,满足游客的需求。

  指定购物出现问题该由谁负责?


  如果在协商一致的前提下,并签订了书面合同,但最后却出现问题,购物需要退货,该由谁负责?


  钟晖表示,只要是签订合同的指定购物,无论是由游客主动要求的购物地,还是导游安排的指定购物地,最终物品出现问题,都是要由旅行社负责。


  《旅游法》规定,在指定具体购物场所的前提下,旅游行程结束后三十日内,如果物品出现问题,可要求旅行社为其办理退货并先行垫付退货款,或者退还另行付费旅游项目的费用。


  钟晖同时表示,消费者主动维护自己的权益是好事情,但是并不能所有事情都“一锅烩”,还要分清什么情况可以投诉退款,什么情况不可以。游客在自由活动时间及非指定购物场所购物,商品出现了问题,则不能享受30天内退货。
