杨桂萍今年69岁，她和71岁的老伴张春义住在三街村已经几十年，是冯井旺的邻居，因为这个违建两家还上了法庭。2011年12月，张春义、杨桂萍为了阻止冯井旺进一步扩大违法建筑，与冯井旺发生争吵，冯井旺当场将张春义、杨桂萍打伤。北京顺义区法院认定71岁的冯井旺犯故意伤害罪，判处有期徒刑一年，缓刑一年。“案子倒是结了，可违法建筑依然还在那里。我们向村委会、杨镇政府、顺义区政府反映了问题有五六十次，都没有用。”杨桂萍很无奈。
记者多次敲打冯井旺家的大门，一直无人应答，拨打冯井旺的手机，也无人接听。三街村不少村民向记者反映，村中这样的违建有多处，以冯家的违建最大，违规占地400多平米，而这些违建的业主大都在当地比较有权势，冯家的违建主要就是在冯井旺的儿子冯长宝的主持下修建的，冯长宝是顺义区教委基建科的副科长。当问及为什么这么多人盖违建时，一个村民说：“还不是为了将来拆迁时能多要补偿款。现在周边的房价都快2万元一平米了。”
这也得到了三街村村委会书记冯文明的证实。他坦言，村里的违建确实“有一些”，按“不报不纠”原则，对这么多违建他也没有办法。村民曾多次投诉冯家的违建，村委会也给冯家下发了违建通知书，要求他们“自行拆除”。“可是他们还占了村里的集体用地和排水沟，如果自己不拆除怎么办？记者问。冯文明没有回答。
记者向顺义区教委了解情况，纪检部门工作人员周晓娟表示，该单位确有副科长冯长宝，并曾多次收到有人举报冯长宝利用职务之便为其父盖违法建筑，此事“正在调查”，但对于违法建筑，教委也“爱莫能助”。记者随后又采访了杨镇镇政府，相关负责人表示，由于违建占的是村集体土地，需由村委会解决，“为了维护稳定，下一步，村委会将继续做其户工作，要求自行拆除。”
北京市建委一位专家告诉记者，从全国范围来讲，相比城市的违建，乡村违建还没有引起足够重视。乡村违建的认定和处理过程要牵涉区县、乡镇、村三级，协调起来比较困难，于是就经常是互相推诿，大家都不管。按照《北京市禁止违法建设若干规定》，违法建设被明确分为城镇违法建设和乡村违法建设两类。“按照北京的这一地方性法规，乡村违建的责任方是乡镇政府。被责令停止建设或者已经建成的乡村违法建设被发现后，在20日内，乡镇政府将依法责令限期改正或限期拆除，期限不超过15日。”这位专家表示，“而如果违建业主逾期不拆除的，应由乡镇人民政府组织拆除。”(光明日报记者 华挺 )

高房价刺激下的乡村违建该重视了
北京人济山庄楼顶的“最牛违建”因为太牛，引起了媒体和社会的聚焦，业主不得不开始拆除。但是，那些不太牛的违建，尤其是在农村和乡镇的大量违建，目前大量存在但却没有引起重视。记者日前在北京顺义区采访中就碰到一例。
北京市顺义区杨镇三街村的村民杨桂萍、张春义和冯井旺是邻居，在村里已经生活了几十年。但几位七旬老人却因为违建而“成仇”，原本一个邻里纠纷让一个七旬老人冯井旺成为罪犯，这让人震惊。更让人震惊的是这件事情反映出的问题。在杨镇三街村，冯家的违建几乎人人皆知，村民的多次投诉，但三街村党支部书记冯文明总是推托，对侵占集体土地的违法建筑没有采取有力措施，并称村里违建太多，法不责众。而杨镇政府也把责任推给了村委会和违建业主。
事实上，不光是三街村，整个杨镇、甚至是整个顺义区，这样的乡村违建都很普遍。顺义区属于北京经济比较发达且离市区较近的郊区，有众多的人流物流，房屋的租赁市场非常火爆。同时，拆迁补偿款也是一笔巨款。顺义区的商品房价格近年来步步高升，现已普遍达每平米两万元左右，一些村民因拆迁所得的补偿款而一夜暴富，也促使更多的村民不惜违法占地，造成既成事实，以期在将来能多要拆迁补偿款。
从全国范围来讲，相比城市的违建，乡村违建还没有引起足够重视。原因主要有二，一是城市违建在政府官员的眼皮底下，城市要评林林种种的文明城市、魅力城市等称号，对违建的容忍度较低，同时城市的媒体资源集中，也容易发现违建。而乡村的违建大多在城乡结合部，“天高皇帝远”，大面积被容忍了下来。
二是管理混乱。城市有城管部门，城管的主要职权之一就是处理城市的违建。而乡村的违建，有些地方如厦门立法将这一块的职权归到了城管，但更多地方是将职权归到乡镇政府，如北京市在2010年专门出台的《北京市禁止违法建设若干规定》。但是在具体实践中，乡村违建的认定过程除了乡镇常常还要涉及村委会，处理过程则要牵涉区、乡镇、村三级，协调起来比较困难，于是就造成了互相推诿，大家都不管，乡村违建就渐渐成了普遍现象。
乡村违建虽然不如城市违建那样引人注目，但危害更大。正是因“默默无闻”，违建在乡村反而数量更多、面积更大，其涉及到的经济利益也十分巨大，尤其是因城市化过程中，乡村违建容易成为违建业主手头的“砝码”，向政府多要本不存在的补偿款。另一方面，乡村违建还容易激化邻里矛盾，成为不稳定因素。像杨镇三街村的例子这样，人被打了，案子判了，但违建依然在那里，隐患并没有消除，如果之后再引发村民的更大的伤害，谁之责？
