新华网昆明12月18日电（记者王研）记者从昆明市中级人民法院获悉，17日，昆明中院对东川“牛奶河”案作出二审判决：因上诉人马世祥主动缴纳罚金、自愿交纳环境污染救济专项资金，被认定为有悔罪认罪表现，二审改判缓刑。
昆明市东川区小江曾因为一度严重污染呈白色，被外界称为“牛奶河”引发舆论关注，昆明市对小江污染一事进行了调查。其中，昆明东海矿业公司、昆明东川通宇选矿厂、昆明兆鑫矿业公司等5家企业存在私设暗管、环保配套设施未完善就私自投入生产等违法行为，致使未经处理的尾矿浆排入小江，导致污染。
11月18日，寻甸县人民法院对此案作出一审判决。昆明东海矿业公司、昆明东川通宇选矿厂、昆明兆鑫矿业公司3被告单位均构成污染环境罪，被处予50万元至75万元不等的罚金，8名责任人中有5人被处缓刑，1人免予刑事处罚，马世祥、李兴平拒不认罪分别被判有期徒刑1年零3个月和8个月。宣判后马世祥提出上诉，要求昆明中院在维持一审定罪、刑期和罚金的基础上，对其改判缓刑。
昆明中院查明：一审开庭后，马世祥及时向一审法院提交了一份书面的认罪说明；在二审开庭审理前，马世祥及该案原审被告单位东海矿业公司、原审被告人李兴平主动向一审法院交纳了单位罚金、个人罚金共85万元；同时马世祥还自愿交纳了环境污染救济专项资金10万元。法院审理认为：根据马世祥在一审宣判后至二审审理期间对其犯罪行为性质及危害后果的深刻认识、反省，及主动交纳罚金和环境公益救济资金等事实，马世祥已经深刻认识到其公司及个人的犯罪行为给当地环境造成的严重破坏和给社会带来的严重危害，表明其具有良好的认罪悔罪表现，符合我国刑法关于缓刑适用的法定条件，依法可对其适用缓刑。
昆明中院依法作出终审判决：改判马世祥犯污染环境罪，判处有期徒刑1年零3个月，缓刑2年零6个月，并处罚金6万元。
