当时宿州市给招商引资企业的优惠政策是，企业每年所缴税中所得部分，可以返还给企业。陈总经理觉得政府给优惠政策是一回事，而真正落实又是一回事，于是想找一个可助协调关系的官员，时任区政府办公室主任的夏令海就这样进入了其视线。
2001年春节，陈总经理到区政府办公室找夏令海说了些过年看望的话，接着闲聊，说他过去也曾当过办公室主任，于是两人因此拉近了关系，有了共同语言。感情拉近后，陈总经理拿出一个信封交给夏令海，夏令海略加推辞便收下，等陈总经理离开打开信封数数，是20张百元大钞。有了第一次，以后的事就自然而然了：当年中秋节，陈某某又到他办公室，以过节看望的名义送去5000元。2002年初的一天，到他办公室，说招商引资优惠政策应该返还的税款一直都没给，请夏主任帮忙协调。夏令海当即表示，他会尽量帮助协调。这次陈某某又给他一个信封，里面装了1万元。夏令海收过陈某某3次好处费后，便找时任区财政局长的黄昌平协调。黄昌平说财政紧张，得等一等，返回税款的事便没有协调好。
2002年中秋节前的一天，陈某某再次找到夏令海，又送上1万元现金，请他帮忙协调，让政府兑现返还税收奖励的政策，自此之后的连续3个春节、中秋节也都登门看望，每次都提让夏令海协调返还税款的事，并且送的“看望费”也涨到了每次2万元。在这期间，夏令海多次找黄昌平协调，但黄昌平也是个不给好处不办事的主儿，一直说区财政紧张，直到2004年才为陈某某的化工集团返还部分税款。陈某某为了感谢夏令海的协调，送给他一个装有5万元现金的纸袋子。在这之后3次逢年过节，陈某某3次看望夏令海，把每次的“看望费”提高到了5万元。
2006年初，黄昌平因受贿落马，夏令海由政府办公室主任改任财政局长。这年中秋节前的一天，陈某某给夏令海打电话，约他到区财政局附近见面，交给他一只装有10万元现金的袋子，说他的招商引资优惠政策马上到期了，现在企业经营困难，想延长期限，让夏令海帮他。夏令海说，这个要区政府批，如果延长了，自己会帮助退税。区政府批准将对陈某某的招商引资优惠政策延长3年后，夏令海每年都安排相关科室，及时给中元化工集团拨付退税款项。为此，陈某某逢年过节看望夏令海，“看望费”翻番，其中2007年到2009年的6个春节、中秋节每次都是10万元。

2010年9、10月份的一天，陈某某找到夏令海，说他的企业要建新厂房，急需资金，希望能尽快把原地块出让金拨付给他。夏令海答应尽量帮他。一个月后，国土部门把第一笔土地出让金1.9亿元转给财政局。按一般程序，拨给企业的资金要由国库科转给企业，但夏令海考虑这笔钱一进国库科，再想转给企业就麻烦了，不仅银行要对这笔资金监管，到银行办手续复杂，耽误时间，而且进国库的资金还要提取教育、水利基金，还要浪费很多时间，所以他就安排这笔资金进企财科，直接转账给陈某某的化工集团。陈某某收到财政局转去的1.9亿元资金后，把夏令海约出去，说非常感谢他帮忙，说完就递上一只装有20万元现金的纸袋子。在之后的过年过节中，陈某某把“看望费”由现金改为购物卡，数额也由原来的一两万元，降为1万元、5000元。至案发，夏令海已收受陈某某人民币128.7万元，购物卡2万元。
2009年，埇桥区政府为扶持当地白酒行业发展，下文通知各乡镇、街道办事处接待用酒一律用区产酒水。当时区产白酒只有古沱酒厂一家的系列酒。各级单位用酒款项均由区财政统一扣除后，由区工业委账户给古沱酒厂。2009年5月份的一天，古沱酒厂厂长王某到区财政局送结算第一批乡镇用酒资金的申请。夏令海看过申请和各乡镇用酒的统计表、收条后，说区财政局要核算之后才能拨付。两个月后，区财政局把第一笔酒款打到区工业委账户，王某闻讯对夏令海很感谢，便借过中秋节看望，拿出事先准备好的2万元现金送给夏令海，说区财政局这么快就把酒款给结算了，非常感谢。夏令海说他以后还会继续支持他们。
古沱酒厂从此每年都要通过财政局审核结算酒款。王某为此从2010年春节到2012年中秋节，每个节日都借过节看望，到夏令海家送钱。从2009年5月到2012年8月，夏令海给古沱酒厂先后结算400多万元酒款，从王某手里收了20万元“感谢费”。
据检察机关侦查、指控和法院审理认定，夏令海在担任埇桥区政府办公室主任、财政局长和融通中小企业信用担保有限公司董事长期间，利用贷款担保、结算政府消费款项、返还土地出让金等时机，先后伸手近200次接受14家企业老板的钱物，金额达190多万元。
敢向兄弟部门伸手
如果说财政局长伸手捞企业老板的钱，是“情理之中，意料之内”的事。那么，作为财政局长的夏令海，竟敢伸手收受政府兄弟局委的贿赂，就有点令人匪夷所思了。
同为政府部门，为什么也像私企老板那样向夏令海进贡呢？原因只有一个：财政局长是财神爷，不给他烧香进贡他不办事。虽然同属政府部门，若想让财政局顺利地拨款，或者落实某项财物，只有向夏局长烧香进贡。自夏令海当财政局长始，埇桥区从农林畜牧到工商科教文卫，再到城乡建设、税务、物价、环保等局委，几乎都向他进贡过，受贿上百次，金额40多万元。给他进贡的钱，当然都是羊毛出在羊身上，来自他拨付给这些部门的资金。
埇桥区机械化管理局局长程某某，仅仅为了让夏令海协调一下本局干部职工的工资，就利用过年过节，先后送给他现金1.4万元；物价局局长为了让夏令海在拨款方面照顾，先后送给他现金2.2万元，而地税分局的局长李某某为求夏令海在拨付经费时照顾支持，先后送给他8.8万元。
劳动就业管理局是个资金相对紧张的部门，但局长李某某为了促进与夏令海的关系，在失业保险救济金的拨付上能够得到照顾和支持，仍要向他进贡。自2008年中秋节开始，逢年过节都给夏令海送钱，10个节日送10次，一次现金1000元。2011年下半年的一天，为了解决人员工资以及工作经费，李某某带着要钱的报告找到夏令海办公室，请他对就业局人员工资和工作经费“费心”，并说“这事区领导已同意了，你看能不能尽快拨给我们”。夏令海看过报告，说会尽快给你们拨付，并在年底拨付给就业局10万元资金。1万元感情投资得到10万元回报，当然是划算的。人员工资和工作经费今后仍要靠夏令海关照，继续投入显然是必需的。于是，李某某又找到夏令海办公室，把装有2000元现金的信封放到他办公桌上，说感谢夏局长及时给就业局里拨付资金。夏令海推辞一下就收入囊中。
“再穷不能穷教育，再苦也不能苦孩子”，这话夏令海当然熟知，但他仍然肆无忌惮地把手伸向学校。
2011年，埇桥区某中学的操场和排水系统准备修缮，因为工程零散，不好整体招标，学校就想以分散采购的方式等发包，工程完成再报销费用。当年12月的一天，校长独某某找夏令海请示，夏令海不置可否地说：“到时候再说吧。”后来独某某分3次给他送了1.5万元，夏令海这才大笔一挥，给该中学工程分散采购一个同意的答复。
第三中学校长梁某某，为在资金拨付等方面得到夏令海的关照，先后在6年12个节日里派自己的驾驶员给夏令海送钱，每个节送2000元，光过节费就送了2.4万元。
2008年3月，三中拟在校内建学生宿舍楼和餐厅，因经费紧张向区政府打报告申请500万元建设资金，区政府批准给他们100万，但财政局迟迟不给拨付。梁校长为了让夏令海尽快拨付该笔资金，便于中秋节前的一天，安排驾驶员又给他送3000元现金，区财政局终于将100万元建设资金拨到了三中账户。据梁校长说，他给夏令海送钱，不仅是为了这100万元建设费，而且希望夏令海在调控择校生的费用收取上对三中照顾，并且还想向财政局要100万元的教育附加费。
在夏令海担任埇桥区财政局长期间，利用解决学校债务、申请教育附加费、调控择校费和教育经费拨付等工作之便，先后伸手20余次，收受宿州市二职高，宿城一中、二中、三中、九中、十一中等6所中学的钱物10余万元。
向下属伸手不脸红
皖北有句俗话“兔子不吃窝边草”。夏令海不是兔子，是财政局长，却频频在窝边伸手，先后收受财政局内部49人的钱物，合计现金80.1万元，购物卡3.2万元。
财政监督检查局局长张某某，为了在工作中得到局长关照，在2007年、2008年两年4个节日中，每节都给夏令海送两条中华烟；2009年改为送钱，少则1000元，多则2000元，逢节必送。2013年初，张某某为了让夏令海把财监工作列入乡镇财政的考评内容，到夏令海办公室送给他3000元现金。夏令海客气一下，欣然笑纳。就这样，张某某先后送给夏令海现金1.4万元。张某某后来说，财政监督检查局是财政局的二级机构，财政局长直接分管，而且财监局的过节费、体检费、办公设备配置等开支要自己解决，开展检查、处罚工作也都需要夏令海批准，然后由他按照罚款数的60%给财监局进行返还，没有夏令海支持，工作不好开展啊。
在夏令海担任财政局长的6年间，埇桥区财政局下属的分局长、财政所长，给夏令海送礼成为惯例，为取得工作照顾的送，为了调动升职的送，为了子女工作安排的也送，各方财政诸侯比着进贡，而向夏令海进贡的钱，他们都以印刷费、修车费、招待费等名义报销，用公款买单了。
夏令海受贿案是由宿州市检察院指定萧县检察院立案侦查并提起公诉的。在法院开庭审理期间，夏令海及其辩护人辩称，他在担任融通中小企业信用担保公司董事长期间，为企业提供贷款担保时，个人并无决定权，所收钱物不是受贿；他逢年过节收钱，并不是因为接受请托事项，不构成受贿。公诉人一一出示证据，证明夏令海在融通担保公司为行贿企业提供贷款担保时，作为董事长都是投的赞成票，而他这一票起关键作用；财政局下属单位人员利用节日看望他，给他送钱，或是为了争取拨款，或是为了调动升迁，或是为了保住位子，无一不是请托事项，而夏令海在收受贿赂后，也都完成了行贿人的请托事项。为此，法院认为，夏令海及其辩护人的辩解不能成立，且夏令海没有法定从轻处罚情节，依法应处10年以上有期徒刑，并据此作出了一审判决。(萧冰)
