杨铭：对，这是案件的需要，这是公安部门办案有规定的。
中国政法大学教授洪道德：我对这个看法持否定意见。这是因为，不立案也是一种结论，不立案也就意味着公安机关不认为这个事件是一个刑事犯罪案件，那么这就是一个结论，而结论既然已经做出来了，那么，支持这个结论的相关根据怎么能够不公之于众呢？如果支持这个结论的相关证据不能拿出来，那么又怎么能让人们相信公安机关不予立案的结论是建立在客观真实充分的证据基础上呢？
洪道德认为，凭借周女士女儿对受害经过的叙述和医院做出的"不排除合并性侵外伤可能"的诊断，此案完全具备立案条件。
洪道德：这个案件在立案之前根本不应该再搞法医鉴定。就是说，仅凭着受害人对自己受害事实的详细陈述以及医院所出具的诊断证明，这两个证据材料就足以达到了立案的条件。因此，立案的两个条件，第一发生了犯罪事实，第二应当追究刑事责任，在这个案件当中就充分具备了。
北京京都律师事务所律师刘铭：我个人认为应该立案。立案之后，他审查的不仅仅是你是不是构成犯罪的证据，还要调查你无罪的证据呢。这些全面的调查，都应该在立案之后的，你立案之前就能排除吗？除非你说这个事情我就能百分之百排除了，或者说我通过录像我看到了小孩就是通过自行的，或者说是摔伤了呀，那可以，否则的话，只要有百分之一有强奸的可能，你就应该立案。更多的工作他是在立案之后进行侦查的。不能在立案之前你就得出这样一个唯一性的结论。这是不符合程序的。
