7 law draws attention to the Standing Committee on the law of marine environmental protection for consideration

Details five aspects:

--Modify the business license, qualification qualification approved by the relevant regulations. Draft modification of existing Customs Act Part 5 of 12 articles of the law to abolish the 8 administrative examination and approval items, focusing on licensing and qualification of enterprise's production and management activities, and so on. Remove the turnover boundary transport means change, diversified into transportation in the territory subject to the relevant provisions of the customs agreement, remove accreditation is compulsory requirement.

--Clear the subject of delegated management layers. Draft modifications of the existing Fisheries Act, drug management law, metrology law of 3 articles, fishing license, 3 administrative examination and approval items, such as pharmaceutical contract manufacturing license consists of administrative departments of the State Council on the implementation of administrative authorities delegated to provincial governments.

--An increase in the ex post regulatory measures. Draft modification of existing 6 articles of the marine environment protection law, customs law, increased the relevant regulatory measures. Draft amendments to the law of marine environmental protection to remove oil spills from offshore oil exploration and development provisions and approval of the emergency plan at the same time, measures to increase filing to regulators; draft amendments to the Customs Act in removing the turnover boundary transport means change, and business ship within approval the relevant provisions at the same time, retained measures consistent with customs supervising and managing requirement and formalities to the customs. --Streamline administrative examination and approval processes. --Modify the relevant provisions of the registration of registered capital of the company. To improve the business environment, 12 articles of draft modifications of the existing company law, company registered capital is actually paid the registration system to a subscription registration system, cancel the minimum registered capital of the company, eased market access control. 　　草案修改的7部法律是海洋环境保护法、药品管理法、计量法、渔业法、海关法、烟草专卖法、公司法，内容涉及取消下放11项行政审批项目和改革工商登记制度。具体内容有五个方面：

　　——修改生产经营活动许可、资质资格认定核准的相关规定。草案修改了现行海关法等5部法律的12个条款，取消8项行政审批项目，重点涉及企业生产经营活动许可和资质认定等。如删除进出境运输工具改、兼营境内运输需经海关同意的相关规定，删除报关员资格核准等规定。

　　——明确下放管理层级的实施主体。草案修改了现行渔业法、药品管理法、计量法的3个条款，将渔业捕捞许可证、药品委托生产许可等3项行政审批项目的实施主体由国务院行政主管部门下放到省级政府行政主管部门。

　　——增加事中事后监管措施。草案修改了现行海洋环境保护法、海关法的6个条款，增加了有关监管措施。海洋环境保护法修正案草案在删除海洋石油勘探开发溢油应急计划审批有关规定的同时，增加了向监管部门备案的措施；海关法修正案草案在删除进出境运输工具改、兼营境内运输审批有关规定的同时，保留了符合海关监管要求和向海关办理手续的措施。在取消报关员资格核准的同时，增加了报关人员违法行为的法律责任。

　　——优化行政审批流程。为减少前置审批环节，草案修改了现行海洋环境保护法，将海洋行政主管部门的海岸工程建设项目环境影响报告书审核改为环保部门审批过程中内部征求意见。

　　——修改公司注册资本登记有关规定。为优化营商环境，草案修改了现行公司法的12个条款，将公司注册资本实缴登记制改为认缴登记制，取消公司注册资本最低限额，放宽了市场主体准入管制。同时为改革监管制度、创新服务方式和减少对市场主体自治事项的干预，公司法修正案草案还明确了公司实收资本不再作为工商登记事项，公司登记时无需提交验资报告。

　　十二届全国人大一次会议批准的国务院机构改革和职能转变方案明确，国务院将进一步减少和下放行政审批事项、改革工商登记制度。在十二届全国人大常委会第三次会议通过了关于修改文物保护法等12部法律的决定后，国务院近期又推出一批行政审批事项改革措施，涉及取消和下放部分法律设定的行政审批事项。为此，国务院建议对海洋环境保护法等7部法律进行一揽子修改。
