Deputy Minister of public security： abolition of re-education through labour system is ripe

Yang Huanning said that with the law on administrative penalties for public security, by operation of law such as drug laws and Criminal Code of continuous improvement, as well as the relevant organic law, reeducation-through-labor system is gradually being replaced by use of re-education through labour measures decreasing started legal proceedings the time is ripe for the abolition of re-education through labour system.

About the work after the abolition of re-education through labour system, said Yang Huanning, after the decision of the national people's Congress made abolition of re-education through labour system, need of relevant laws, regulations, judicial interpretations, regulations and regulatory documents in accordance with legal procedures to clean up. 　　新华网北京12月23日电 十二届全国人大常委会第六次会议23日开始审议国务院关于提请废止《国务院关于劳动教养问题的决定》和《国务院关于劳动教养的补充规定》的议案。受国务院委托，公安部副部长杨焕宁就上述议案向会议作说明。

　　杨焕宁在说明中指出，1957年8月1日，第一届全国人大常委会第七十八次会议批准了《国务院关于劳动教养问题的决定》，依法确立了劳动教养制度。1979年11月29日，第五届全国人大常委会第十二次会议批准了《国务院关于劳动教养的补充规定》，进一步明确了劳动教养管理委员会的设立、劳动教养的期限以及人民检察院对劳动教养机关活动的监督。

　　议案指出，劳动教养制度依法施行50多年来，为维护社会治安秩序、确保社会稳定、教育挽救违法人员发挥了历史性的重要作用。随着我国社会主义民主法治建设的推进和法律体系的不断完善，劳动教养制度的历史作用已经完成。

　　杨焕宁说，随着治安管理处罚法、禁毒法等法律的施行和刑法的不断完善以及相关法律的有机衔接，劳动教养制度的作用逐渐被取代，劳动教养措施的使用逐年减少，启动法律程序废止劳动教养制度的时机已经成熟。

　　关于废止劳动教养制度后的相关工作，杨焕宁说，全国人大常委会作出废止劳教制度决定后，需要对相关法律、法规、司法解释、规章和规范性文件依照法定程序进行清理。国务院将组织有关部门妥善做好被劳动教养人员依法解除劳动教养、劳动教养管理机关人民警察的职能转变和劳动教养场所的合理利用等工作。
