　　鉴定行凶者患精神分裂症

　　在本案中，两份司法鉴定结果不一致曾经成为原告、被告方争议焦点：今年2月，警方通报称经南京脑科医院司法鉴定所鉴定，彩春锋患精神分裂症(偏执型)，作案时无刑事责任能力。受害人及其家属表示无法接受，要求重新鉴定。

　　今年4月16日，经上海市精神卫生中心司法鉴定所鉴定，彩春锋患有偏执精神障碍，作案时具有限定刑事责任能力。

　　法院认为，被告彩春锋仅仅有妄想症状，除妄想外并无明确的感知觉障碍、思维形式障碍和精神分裂症状，其次在案发前，其并没有发病史和治疗史。

　　在羁押期间，其没有服用任何精神类药物。综上分析法院认定其患有偏执性精神障碍，系限制刑事责任能力人。

　　去年11月6日，42岁的彩春锋因患有肾结石，前往安徽医科大学第二附属医院住院治疗。在接受了术前“灌肠”和“皮试”后感觉身体不适，遂拒绝接受手术治疗，并对医护人员心存猜疑，产生报复心理。

　　同年11月13日，彩春锋到某超市购买了一把菜刀，持刀来到安徽医科大学二附院，拿出菜刀向护士长戴光琼后颈部连砍两刀，将戴当场砍倒在地。随后，他手持菜刀追砍另一名护士，伤及后颈部，并砍伤前来制止他行凶的三名医护人员。被害人戴光琼经抢救无效死亡，三名医护人员轻伤，一名医护人员轻微伤。
