  关于楼盘的持证情况,该销售人员称,“现在还不全”,目前仅持有国有土地使用证、建设用地规划许可证、建设工程规划许可证3证,其余两项证件仍在办理之中。

  无证楼盘施工叫不停是谁的责任

  南阳市昊鼎置业有限公司董事长朱明国也表示,此前因为停工,已有安置户及农民工上门闹过多次。


  但《城乡规划法》、《建筑法》等规定,证件不齐的情况下,不得开工建设并预售。


  刘伟说,此前已经对该项目下发过停工通知书。但对于被责令停工项目再次动工一事是否知情,刘伟并未作正面回应,只是表示“如果发现了就制止”。对于无证楼盘施工为何叫停无效,刘伟表示,将与相关执法部门了解过后作出答复。


  中国政法大学教授郎佩娟表示,无证建筑继续开工建设,政府相关职能部门将承担失职的责任。根据《城乡规划法》及建设部门的相关法律规定,开发商也要受到一定处罚。她还表示,如果政府部门对本应停工建筑仍在赶工的现象视而不见,属于不履行法定职责。


  对于主管领导和工作人员应当承担何种处分,郎佩娟说:“一要看情节,二要看其造成的社会后果是否严重。最轻的是警告,然后记过、记大过等。如果因为此事让政府的形象或公信力受到影响,可能就要承担比较重的行政责任。”


  无证不能预售的规定形同虚设


  记者又走访了南阳多处楼盘,发现楼盘证件不齐就施工、销售的情况并不鲜见。


  余大妈(化名)的儿子今年刚刚毕业,这段时间,她一直四处给儿子看房。“南都·秋实苑”是她今天转的第4家楼盘。


  “感觉这儿户型还不错,周边交通啥的也挺方便。”余大妈相中了一套100多平方米的房子。但对于楼盘预售应当持有的5个证件,余大妈只是略知一二,“没怎么问过,应该没事吧,这么大的盘在这儿。”


  在“南都·秋实苑”的售楼大厅内,展示有国有土地使用证、建设用地规划许可证、建设工程规划许可证3证。售楼人员表示,其余两证还在办理中,但只要有土地证和规划证就行,其他证件都好办。


  “梅溪新天地”楼盘售楼人员表示,“预售证肯定没有”,目前只有国有土地使用证,其余证件仍在办理中。但300多套房屋,目前仅剩十几套还没卖完。


  “中州·锦城华府”楼盘售楼人员也告诉记者,3幢高层中仅剩几套房源,但目前手续还不全,只有批函,相关证件还在办理中。“在南阳,有批函就相当于有证件了。”销售人员表示,这是城中村改造项目,政府都比较支持,证件不会办不下来。


  “卢浮公馆”楼盘正在认筹阶段,证件尚在办理中。“我们老板实力是比较强的。”该楼盘销售人员说,证都没有问题,肯定能办下来。


  此外,中国青年报记者调查发现,万达国际、摩根·中央公园、同晟国际、翰林华府等多处楼盘亦存在证件不齐但已经在销售的情况。


  2010年颁布的《住房和城乡建设部关于进一步加强房地产市场监管完善商品住房预售制度有关问题的通知》明确规定,未取得预售许可的商品住房项目,房地产开发企业不得进行预售,不得以认购、预订、排号、发放VIP卡等方式向买受人收取或变相收取定金、预定款等性质的费用,不得参加任何展销活动。


  此前,南阳市房产管理局办公室主任李学军也明确向记者表示,在没有取得预售许可证的情况下,开发商不得进行预售。


  但上述楼盘的销售人员均表示,证件不齐,不影响交钱买房。看中房屋后,先交1万~2万元不等的订金,然后在7天内交齐首付或全款,便可签订购房协议,等商品房预售许可证办理以后,再签订正式合同。


  对此,南阳市市委宣传部新闻科科长袁延德表示,按照规定,在预售之前应该把所有的证件都办齐。但对于南阳市多处楼盘存在证件不齐即开工、预售的情况,袁延德表示,还需要联系国土、规划、住建等多个部门落实此事,之后会给记者答复。
