  报告显示,从群众来信来电和网上征求意见看,反映的主要问题还有:行政复议与信访之间缺乏有效衔接;有些行政复议机关不履行复议职责,有案不受;有的行政机关拒绝履行生效的行政复议决定,导致申请人反复上访;有的复议机关更多考虑被申请人利益,对有明显错误的行政行为,违背申请人意愿进行调解。


  全国人大常委会执法检查组检查发现,在复议程序方面,目前多数复议机关办理行政复议案件,以书面审查为主,文来文往,层层审批,程序繁杂且不够公开透明,行政相对人参与不够。


  “各级政府行政复议能力普遍偏弱,与承担的工作任务不相适应,影响行政复议机关及时受理和依法办理复议案件。”全国人大常委会副委员长王胜俊23日向常委会报告执法检查情况时说。


  检查发现,行政复议能力建设滞后问题在县级政府尤其突出,不少县级政府法制机构是政府办公室内部挂牌机构,约38.2%的县级政府没有设立法制机构或者只挂牌无编制,平均每个县级政府专职行政复议人员不到1人,人员素质、经费保障、办公场所等普遍不能满足办理行政复议案件的需要。


  在执法检查涉及的15个省份1407个县中,2011年和2012年,分别有306个县和277个县没有办理行政复议案件,有的县甚至从行政复议法实施以来没有办理一起行政复议案件。但这些县每年信访数量少的三四百件,多的上千件。


  据统计,目前90%的行政争议发生在基层,行政复议工作的重点应当也在基层,县级政府行政复议工作的现状与中央提出的将行政争议化解在基层、化解在初发阶段的要求还有较大差距。


  报告建议,切实加强行政复议能力建设。适当充实案件数量多、工作压力大的行政复议机构人员,充分发挥县级政府行政复议职能,努力将矛盾化解在初发阶段,化解在基层,化解在群众身边,避免矛盾上移,降低纠纷解决成本。


  同时,总结各地相对集中复议权试点经验,合理确定复议受理机关,研究整合复议资源、提高复议效率,进一步完善行政复议体制,尽力避免“有案无人办”和“有人无案办”的现象。
