持续高额研发投入使华为积累了较强的专利实力。据了解，华为2015年研发投入92亿美元进行新技术和新产品的研发，占销售额的15%，已经超过苹果的85亿研发投入，占销售额3.5%。目前，华为累计中国申请专利52550件。
而专利申请数量并不意味着一家企业在专利上面的积累和优势，被授权的专利才可以拥有真正话语权，尤其是在国际领域的专利诉讼案中，都是以海外被授权专利为法律依据点。苹果向华为支付专利费也是基于此原因。
根据华为最新披露的数据，截至去年年底，华为累计已授权专利30924件。各区域均保持了稳定增长。美国授权专利5052件，其中2015年新增授权1268件；累计欧洲各国授权专利11474件，其中2015年授权2247件。
华为消费者BG去年共申请专利9000件。其中，中国申请6200件，境外申请2800件。同时已经获得中国专利授权2000多件，欧美等境外专利授权1100多件。
需要指出的是，近几年对于专利的重视已不仅仅是华为一家，面对出海遭遇的专利诉讼，其他国产品牌也开始加速储备，小米公司便是最典型的案例。
2014年下半年，小米手机的火爆销售就因侵犯爱立信专利权而遭受重挫。汲取教训后，今年2月，小米从美国芯片巨头英特尔公司大手笔买了332件美国专利，之前其还收购了博通公司的一些无线通信专利。
国际知名专利检索公司QUESTEL在近日发布的报告中指出，中国芯片专利申请量在过去18年里则实现了23倍的惊人增长。
分析人士指出，数量上中国已成为芯片专利申请第一大国，在芯片领域取得的突破从侧面反映了国产智能手机已经开启了“逆袭”模式。但在国内，专利保护及监管上仍有漏洞，苹果向华为支付专利费一方面说明中国企业在全球专利话语权的提升，另一方面也是刺激其他国产品牌尊重专利保护并加速专利储备。
去年，网传中兴、华为向包括小米、vivo、OPPO、步步高在内的手机厂商广发“律师函”，指称后者侵犯了其WCDMA专利。
对于此次华为是否会向国内厂商收取专利费用，华为相关人士表示，国内知识产权环境还不健全，不便透露更多信息。
