另一个类似的诉讼则是关于Facebook,中国广东省中山市的珠江饮料厂曾经在2014年注册了“face book”这一商标,这家企业主要生产薯片或罐装蔬菜等产品。而根据北京高级人民法院的最新判决,国内商标监管机构不应该在2014年授予上述这家企业这一商标,即这侵犯了Facebook公司的商标权。

根据中国国内的法律,如果一家跨国企业希望主张在国内的商标权,这家公司必须能够证明这一商标和品牌在中国国内也有着比较高的知名度。所以,这么看的话,Facebook如今算是在中国有较高的知名度,而当年的iPhone则并不为人所熟知。

有时候,法律通过,并不意味着商业道德上的通过,比如陆风山寨路虎的事实摆在那里,不过鸡贼的陆风先于路虎在国内拿到了外观专利。相比于国内媒体对于这一次Facebook商标案的事实性描写,外媒显然不高兴了,即便这一次Facebook赢了官司。
