各大在线音乐平台肆无忌怠的盗用音乐人的作品和版权、用户随意试听和下载数字音乐，音乐人和唱片公司苦不堪言，这就是2015年之前国内音乐产业的现状。然而看似美好的一切，却被去年一条号称“史上最严版权令”所终结，也就是由国家版权局发布的《关于责令网络音乐服务商停止未经授权传播音乐作品的通知》。通知下发仅2个月时间，各大在线音乐平台下架的歌曲就达到220余万首。与此同时用户也发现，以前很多可以免费试听和下载的音乐，要么已下架要么付费才能下载，不信的话现在就随便点开手机里的音乐app看看就知道了。
笔者一直都是QQ、网易、虾米音乐的用户（也经常是付费用户），对于支持正版音乐这件事也是双手赞成，要知道国家版权局下发的通知不仅是为了保护音乐人的版权和利益；同时也是与国际接轨，让早已混乱不堪的国内音乐产业往健康良性的方向发展。前段时间国家版权局副局长阎晓宏还表示：“不付费使用音乐作品的时代已经过去了”。
然而以用户的角度来看，笔者认为国内在线音乐平台还远没有摆脱盗版、违法、侵权等行为，免费下载、使用音乐作品的现象依旧普遍，和国外在线音乐市场还有着很大的差距。当然笔者绝对不会凭空发表这些言论，而是在实际体验对比一番后才发现，国内外音乐版权保护意识的差距还是非常大的。
国内音乐平台现状
先来说说国内各大在线音乐平台的付费模式和体验，以QQ、虾米、网易三大主流在线音乐平台为例，各家都已制定了一套“标准”的付费会员模式，基本分为10元左右的包月套餐和100元左右的包年套餐，付费用户可享受每月不限量在线试听和下载一定数量的高品质音乐（例如QQ音乐付费用户可享受每月300首音乐下载）。
此外，笔者最近发现各大主流音乐平台还都额外增加了付费音乐包项目（一般为每月10元左右），用于让用户购买指定付费专辑，因为像周杰伦、李荣浩、Adele等大牌港台、海外音乐人的数字专辑都是需要单独购买的。也就是说，即便你是以上三家音乐平台的包月/包年用户，还是不能随便试听和下载所有音乐。如果你是个纯音乐控的话，那么每个月花在数字音乐上的钱可绝对不止10块钱这么点了。

国外各大在线音乐平台一般也分为包月和包年会员，此外还会附加一个家庭会员模式，用户只需多花一点点钱就可以添加更多的人一起共享音乐。并且用户无需再支付任何额外的费用，平台上所有专辑都可以无限畅听（但不能下载）。相比于国内音乐平台上的各种变相收费，国外音乐平台则显得规范的多。
如果说以上的区别还不足以体现中外在线音乐平台之间的差距，那么下面这点不同绝对体现了中西方国家对于音乐版权保护意识的巨大差距——下载。我们都知道，不论是QQ、虾米还是网易云音乐，都提供了将在线音乐下载到本地的服务（免费用户与付费用户均可），对于用户来说，既可以将下载的专辑保存到硬盘里，也可以分享给其他人，甚至可以通过电脑刻录成盗版CD拿到外面售卖。

然而，在没有得到版权许可的前提下，以上这些行为都是属于违法的；而作为数字音乐提供商的QQ、网易、虾米，无疑为国内盗版音乐的制造和传播提供了一个通道，由于目前并未有明确的法律监管措施，最终的受害者还是音乐人，所以从这方面看，不付费使用音乐作品的时代其实还没有过去。
国外音乐平台现状
相比于国内各大在线音乐平台“宽松自由”的下载模式，国外在线音乐平台对于数字音乐版权的保护则是非常严格的，以目前两大在线音乐巨头Spotify和Apple Music为例，前者可免费使用（但很多功能受限），后者则必须每月支付10元RMB才能使用。但不管怎样，用户在以上音乐平台听歌只享有在线点播和离线使用两个功能。
请注意，这里的离线使用和国内音乐平台的下载可完全是两码事，所谓离线使用，其实只是将音乐缓存到你的播放列表里，以便在没有网络的环境下使用；用户不能将离线音乐下载到本地，更不能传播，所以你唯一能做的事就是听。而且，当付费期结束后如果不及时续费的话，用户会发现自己播放列表里的离线音乐已全部无法使用，续费后需要重新离线缓存。

所以从体验上来说，国外在线音乐平台并没有QQ、网易、虾米好用，付费用户享受的服务也很单一，但前者却最大程度的保证了其平台上每个音乐人的版权和利益。当音乐人的作品得到了应有的保护和回报时，这个国家的音乐产业才能健康蓬勃发展，好的音乐才会越来越多。而相比之下，我们现在差的还很远。

其实从去年的“最严版权令”下发以来，国内音乐版权环境正在逐渐好转，以前一直处于弱势群体的音乐人也终于得到了一些尊重和保护。但从目前来看，音乐人还没有从售出的数字专辑中拿到与作品等值的回报，盗版音乐依旧存在。相关法律法规的缺失是主要原因，另一方面，国人对于版权的意识还没有建立起来，人们还处在免费与盗版的过渡期。不过令人感到欣慰的是，政府近两年对版权的治理力度越来越大，加上大众版权意识的逐渐形成，在未来几年里，未经授权的数字音乐将很难再成为盗版商牟取暴利的手段，行业和市场会更加规范，也希望这一天不要让我们等得太久。
