  2016年8月8日,身患癌症的前华为高管魏延政去世,享年41岁,魏延政的妻子代他发朋友圈向大家道别。大家的心情正如之前检查时医生所说,“这么年轻,太可惜了”。


  魏延政在《我在华为的半打岁月》、《我在华为的抗癌岁月》和《人生若如几回忆》几篇文章中曾详述患病以来的经历,以及与公司的关系。


  毕业于北大计算机系,后于英国南安普顿大学获得博士学位的魏延政,曾供职于英国电信研究院CTO office。2006年回国加入华为,并从技术转向市场,因工作优异很快升为18级专家。


  2011年,查出“透明细胞肉瘤”,是一种三年死亡率高达80%的绝症。扩大切除后,又回到了工作岗位,此后两年中经历了扩散、截肢、放疗、化疗、复发、扩散反复的过程。

  面对身患最罕见恶性肿瘤的高管,以加班文化、苦难辉煌著称的华为成为了网友们的声讨对象,同时也引发了关于员工患病与公司责任的巨大争论。


  网友们的争论主要集中于几点:华为按规定给予魏延政赔偿,合法但不合情;面对身患重症的魏延政,应该给予病人更多关怀;华为按企业规定做事,不应该对其实施“道德绑架”;国家、组织都不可靠,亲人健康最重要。


  其实归根结底还在于,华为给魏延政的赔偿到底合不合理?面对这样的重症病人,华为及其他企业摆出什么样的姿态或承担多少责任才算有人性?


  ‘ 华为到底给魏延政多少赔偿? ’


  “华为到底给魏延政赔偿了多少钱?”,“病假期间的工资、股权分红算不算赔偿?”,这是外界最关心的问题,这也是切实关系到每个员工的利益点。


  根据魏延政的文章内容,2012年华为通过大病商业保险向他一次性赔付20万,2013年华为按上海平均工资的基准进行3200×(N+1)的赔偿,期间签订了两年的长期病假合同。


  他也写到,“家里有癌症病人、手术、放疗、化疗一通下来,你们就会清楚 20 万够多大点屁用!我的恶性肿瘤是肉瘤里最罕见也恶性最强的,现有的化疗药对我根本不起作用。3200×(N+1),确实够买那么一两包没啥用处的药水的。也能买那么几包奶粉。”


  这样看来,华为对魏延政的赔偿应该是大病商业保险赔付的20万以及3200×(N+1)的补偿以及长期病假。但从魏延政的话看来,对华为给予的这些赔偿他是很不满意的,他甚至以华为的巨额捐款来进行对比。


  但也有华为的内部员工分析,像魏延政这样的高管,他每年的个人收入不至于看不起病,他是想给自己的家人留有更多保障。


  作为18级员工,已经处于食物链的顶端,每年的年薪应该在百万左右,而且还有相应的股票分红,大约120万~300万。华为”心声社区“上的一位员工提到,因为他不菲的个人收入,很多人对他的同情也减了几分。甚至有人认为他是不满足,不懂感恩东家。


  然而,正当工作所得和公司赔偿毕竟是两个概念,工作所得是从个人角度而言的,赔偿是从公司角度而言的。魏延政靠自己工作获得的工资和股权分红,应不应该被视为他不可以获得更多赔偿的前提?


  目前,华为方面还未对相关的赔偿进行回应。


  ‘ 除了重病,过劳死事件也难断 ’


  除了员工身患重病死亡,近几年随着互联网的迅猛发展,高强度、绩效考核、经常加班等因素导致员工猝死的事件屡见不鲜。


  2014年4月3日晚,网友“少年判官大人”微博爆料称,一位在阿里工作6年的怀孕员工因子宫大出血死亡,而其家属认为导致其死亡的主要原因是超负荷工作引发的过劳死。该网友认为“元凶”系阿里不合理的制度设计和绩效考核。


  爆料称,该孕妇4月2日午夜还在为请孕假做交接工作。而且该员工在今年被检查出宫外孕后,因不想在四月份发年终奖时,被考核落下,便没去检查身体。在接到去世通知后,阿里立即成立了事故应急处理小组,协助该员工家人办理后置手续赔偿手续。


  这样的事发生一年后,腾讯也出现员工过劳死事件。2015年12月15日,腾讯游戏高级副总裁马晓轶在部门内部发信称:技术研发中心语音引擎组副组长frontlee(李俊明)12月13日晚,和往常一样陪妻子在小区散步时突然晕倒在地,后抢救无效去世。


  消息一出,在腾讯内部引起一片哗然。虽然李俊明的死亡并非发生在加班的过程中,但不少腾讯员工认为他是因为长期加班造成的过劳死。因此多名员工联名要求腾讯正视员过劳加班问题,避免悲剧再度发生。随后,公司高管表态称,公司会最大限度帮助家属度过难关,并承诺采取各种措施减少加班。


  今年5月,过劳死的悲剧再次发生,网易女编辑因肝癌去世,年仅28岁。3月7日,她在微博写下了“生命进入倒计时!“这句让人感伤的话,4月初她转发了@人民日报 《从疲劳到癌症仅需4步!你还在透支身体吗?》一文,并配文“我就是例子啊”。


  让人悲哀的是,这样的过劳死事情可能还会发生。如今,工作生活很多时候都没有明确的界限,出现这样的情况,企业到底该怎么做?


  ‘ 公司承担多少责任才算有人性? ’


  关于“经济补偿”,《劳动合同法》规定的:经济补偿按劳动者在本单位工作的年限,每满一年支付一个月工资的标准向劳动者支付。六个月以上不满一年的,按一年计算;不满六个月的,向劳动者支付半个月工资的经济补偿。


  劳动者月工资高于用人单位所在直辖市、设区的市级人民政府公布的本地区上年度职工月平均工资三倍的,向其支付经济补偿的标准按职工月平均工资三倍的数额支付,向其支付经济补偿的年限最高不超过十二年。本条所称月工资是指劳动者在劳动合同解除或者终止前十二个月的平均工资。


  就华为对魏延政的赔偿标准来看,是按上海平均工资4000元的80%(3200)乘以N+1进行补偿的。即便加上大病商业保险的20万,还是有很多网友认为,华为是狼一样的公司,无情无人性。


  对于阿里、腾讯和网易这三起过劳死,我们并没有看到具体的赔偿情况,也无法评判对员工是否合情合理。不过,科技公司已经在不断完善相关的福利制度。


  今年6月,腾讯薪酬福利部助理总经理、腾讯人力资源总监方慧玲在“腾讯员工购房嘉年华”活动上表示,跟谷歌一样,腾讯公司内部也有类似的员工“死后福利(death benefits)”。


  方慧玲表示,在腾讯,过世员工的家属同样可以领半薪十年。如果该员工有孩子,每多一个孩子额度会有额外增加,每个孩子增加12个月薪。在具体发放上,一部分是一次支付,因为发生不幸时,家人会需要用钱;另一部分,腾讯会通过信托公司处理。


  早在2012年8月,谷歌就推出了“死后福利”,谷歌员工因意外去世后,其配偶可以在10年之内继续领取去世员工生前50%的薪水。而且员工死亡后股票马上归属于他们自己,死亡员工的孩子每人每月将收到1000美元,直到19岁为止,对于专职学生则是23岁,并且“死亡福利”没有员工任职年限的要求。
