地铁1号线四惠地铁站外,一位黑摩的车主告诉北青报记者,前几个月有一个名为“小车跑跑”的叫车软件的工作人员曾经找到他,希望他能加入该软件成为一名车主,“我害怕被人抓了,所以没有加入”。

北青报记者在苹果APP商城看到,确实有一款名为“小车跑跑”的约车软件。该软件内容介绍显示,“软件的目标是解决城市交通最后一公里的问题,用户通过小车跑跑可以获得更安全、更高效、性价比更高的交通出行服务”。

针对快递软件被黑摩的滥用情况,北京市康达律师事务所律师韩骁表示,用户明知快递摩托车、电瓶车等不属于可载客的交通运输方式,仍然乘坐,存在过错。快递员通过手机APP超出快递寄递范畴揽客,也存在过错。如果发生安全事故,在没有第三方侵权的情况下,用户与快递员应按各自过错范围内承担过错责任。

如果用户乘坐网约黑摩的造成人身财产损害,自己要承担一部分责任,同时还可以向车主,以及未尽到监管责任的APP平台承担各自过错范围内的赔偿责任。如果网约黑摩的造成第三方人身财产损害,则快递员及未尽责的APP平台应承担损害赔偿责任。
