“不要问我为什么，老板说动手我就动手，反正一句话，权大于法。”江西资溪县国土局执法大队大队长吴建称，作为下属，只能服从领导指示。2016年12月6日，二十多个城管队员在副县长吴辉文的指挥下抡起铁镐、铁锹将资溪县农民徐晓洪家刚建起的屋墙推到。
“不要问我为什么，老板（副县长）说动手我就动手，他说拆我们就拆。”资溪县国土局执法大队大队长吴建表示，自己只是服从领导指示，不知道为什么拆房，“反正一句话说到底，就是权大于法”。
2016年12月6日下午，江西省抚州市资溪县鹤城镇泸声村，在副县长吴辉文的指挥下，二十多个城管队员抡起铁镐、铁锹将该县农民徐晓洪家刚建起的屋墙推到。
为建住房，徐晓洪及家人奔走8年。期间因办证困难等事宜，曾起诉资溪县建设局及国土局。2016年8月，在法院的支持下，徐晓洪拿到农村建房必须的两证一书，新房正式开工。但如今，宅基地上却是一片废墟。
事后，徐家以吴辉文等人损害财物为由，向资溪县公安局报案，但目前未能立案。
建房审批耗时八年
“我们一家四口连个家也没有，花了八年时间才把审批手续办下来。”
徐晓洪，资溪县鹤城镇泸声村农民，1972年生人，和妻子育两子，一家四口一直和老人挤在一幢老房子里。眼看着两个孩子快长大成人，徐晓洪急切需要有自己的房子。
2008年6月，徐晓洪按照一户一宅的相关规定向村委会以及鹤城镇政府提交了建房用地审批表。但是一晃三年过去了，却一直没有得到批复。老徐询问原因，但相关部门一直不给说法。
由于徐晓洪远在内蒙经商，建房的后续事宜就交给父亲老徐办理。

直到2011年，资溪县准备修建一条城南公路，需要征用村里的土地。根据江西省政府对被征地农民妥善解决住房、就业等问题的精神，老徐终于拿到期盼已久的建设用地批准书和建设用地规划证可证。
农村建房必须两证一书，只要再取得建设工程许可证就能开工。但是资溪县建设局却以规划没有落实为由，要求老徐再等等。
“我们所持有的证件是有时效限制的，我不能再等了，再等这些都要过期了。”因为担心证件过期带来更大麻烦，2016年4月1日，徐家向抚州市临川区人民法院提起行政诉讼，资溪县建设局成为被告。
半个月后，临川区人民法院向双方送达了传票。就在送达传票的第二天，资溪县建设局将建设工程规划许可证直接送到了老徐的手里，并要求老徐立即撤诉。
历经八年，老徐终于替儿子办好了所有的建房手续。
国土局接连“发难”
在拿到建设工程规划许可证后不到一个月，老徐接到资溪县国土局下发的责令退还被征土地的通知书。这让老徐彻底懵了，经过国土局批准的建设用地，怎么突然就变成了“被征土地”了呢？
老徐向抚州市国土局反映情况，抚州市国土局要求资溪县国土局出具法律依据。资溪县国土局副局长带人到现场查看之后，表示“弄错了”。
“一场误会”之后 ，老徐又开始忙活平地基，然而事情远没有结束。
2016年9月14号，资溪县国土局以涉嫌违反《土地权属争议调查处理办法》第22条的规定，给老徐下发责令停止违法行为通知书，要求立即停止建房。
老徐认为，资溪县国土局适用法律明显不当。权属纠纷主要是使用权和所有权的纠纷。老徐报批建房的地是农村集体所有的土地，所有权无可争议。至于使用权，政府部门已经批准同意建房，即意味着取得了土地的使用权。无论是所有权还是使用权都非常明确，根本不存在争议。
“国土局那个工作人员讲，没有办法，领导要我们这样做，我只能这样做，我说事情到这个地步，我们只能在法庭上见。”倔强的老徐第二次向临川区法院递交了起诉状，这一次的被告是资溪县国土局。
2016年11月23号，法院开庭审理了此案。
“法官当天叫国土局把通知书撤销。为了维护政府的形象，没有判决，判决不大好看。”11月25号，资溪县国土局撤销了之前下发的责令停止违法行为通知书，老徐撤诉。这一次，盖房的进程又耽搁了两个多月。
副县长亲自带人拆房
老徐没想到，12月6号，副县长吴辉文竟然亲自带人来拆房。
老徐回忆事发当天，吴辉文带着鹤城镇党委书记乔志平，镇长李志刚，还有鹤城派出所民警、房管局、建设局、国土局、城管局等七八十人来到工地，在没有出示任何书面通知的情况下，二十多名手持铁镐、铁锹的城管队员就将刚刚浇好的混凝土墙体推倒。

他试图找吴辉文交涉，但被鹤城镇党委书记乔志平拉开。
老徐后来找到资溪县国土局法规股才知道，原来就在国土局撤销停止违法通知书之后没几天，一个叫席会平的村民写了一封信访件交给信访局，提出老徐家占用了村里的机动地建房，全村绝大部分村民都签了字。
国土局法规股的工作人员经过调查发现，这些签名中有的是代签的，甚至还出现了服刑人员的名字。正是这份信访件直接导致了拆房事件的发生。
“建房的那块地一直是儿子承包的，取得了农村土地承包经营权证，承包期是30年，从1998年1月1日到2027年12月31日。”老徐不明白，这块地怎么就成了人人有份的机动地呢？那份信访件到底是怎么产生的？
村民林长麟告诉“北京时间”，那块地的确是徐晓洪承包的责任田，至于那份村民集体签名的信访件，则是村民席会平在村里挨家挨户找人签字，并承诺凡是签字的村民，不仅有饭吃，还给钱，目的就是要收回老徐建房的地。
林长麟也被要求在信访件上签字，但是因为违背基本事实，他拒绝了。
席会平为什么会闹这么一出？“我听人说，是鹤城镇政府唆使，”林长麟听到了一些风声，“让村民签字，把老徐家的两证一书撤回来，那片地收回来之后再安置其他村民”。
鹤城镇党委书记乔志平对此回应，这块地存在权属纠纷，他曾经口头通知老徐停止建房，老徐却置若罔闻，坚持要看到正式的停建通知才肯停建。但是村民意见也是越来越大，迫于压力，才去“恢复原状”的。
当“北京时间”追问有没有法律依据时，乔志平说，“政府也有做错事的时候。”
执法人员承认“违法”
老徐想不明白，千辛万苦把证办下来了，怎么房子还是不能建？竟把副县长也惊动了？
“这些部门都知道老徐是有齐全的建房手续的，所以当时接到拆房通知时，大家都一头雾水。“北京时间”（微信号：btime007）以家属身份陪同老徐找到国 土局综合执法大队大队长吴建，他透露，当天下午两点半，国土局、建设局、房管局等相关部门都接到了副县长的电话，要求各部门配合统一行动。“老板说拆就拆，法律法规都要靠边站。有些东西是政府主导的，不是说法规怎么样。”
吴建还表示，9月14号下发给老徐的那份停止违法行为通知书，也是在有关领导的指示下下达的。“我明明知道那个是违法的，但是领导要我下，我只能下，下了也是准备败诉。目的就是跟他耗时间，不让他建房子。”
“他取得了两证一书，现在老百姓认为程序有问题，审查不严就要有人承担责任，所以政府也很为难。”资溪县政府法制办周主任称，因为许多村民对老徐建房的这块地提出了权属争议，但是，老徐又是在相关部门合法取得的建房手续。那么，在这种情况下，就必须要有人承担责任，因此，徐家最后就成了牺牲品。
2016年12月27日，吴辉文在电话中向“北京时间”（微信号：btime007）表示，拆除徐家在建房屋，是因为徐晓洪不符合一户一宅，且占用了村小组的机动地，被村民举报。并且在审批过程中，徐晓洪虽然取得了村小组的同意，但是并没有依法召开村民会议表决通过。
他称，下一步将要撤销老徐的两证一书，如果老徐对此有异议，可以走法律途径解决。
吴辉文表示，拆除行为“依法依规”。
但当北京时间进一步追问法规依据时，对方匆匆挂掉了电话。
江西省平常心律师事务所刘立立律师认为，资溪县副县长吴辉文在没有任何法律程序和法律依据的情况，在权属纠纷没有处理之前，将取得了合法手续的在建房屋进行拆除，已经涉嫌滥用职权。
2016年12月29日消息，徐晓洪的“建设用地批准书”被资溪县国土局撤销。
