12月6日上午，在资溪县国土局、鹤城镇等相关单位未调查核实清楚前，徐晓洪又开始建设墙裙。当日，鹤城镇30多名干职工在现场进行劝阻，但徐晓洪及家人依然在中午两点左右将墙裙浇筑完工。施工过程中，该村小组10多名群众代表再次到镇、县两级政府上访，指责政府处置不力、行政不作为。
为避免村民双方矛盾冲突，如违建势必对徐晓洪造成更大损失，县政府研究决定，在未调查核实之前保持土地现状，并及时组织国土、建设、城管、鹤城镇等相关单位对徐晓洪抢建部分进行拆除。
当事人称省略村民小组会议系惯例
“实际操作中，申请宅基地时基本上都省略了开村民小组会议的程序。按这么说，大家的房子岂不是都要拆掉。”老徐告诉“北京时间”，村小组长都签字盖章同意建房，他若是要求开村民小组会，反倒会被认为没事找事，给建房带来不必要的麻烦。“走不走程序，不是我能控制的。”
“在审批的八年时间里，乡镇政府、县政府，以及国土局、建设局等部门都没有对此提出过异议。拿到了两证一书开始建房了，却以没有召开村民会议为由撤销了建设用地批准书。”老徐认为，政府部门提出程序不合法的时间也有失公平。
对于有三套房子的说法，在老徐看来，这是资溪县政府玩的文字游戏。老徐解释，自家确实有三套房子，但都不是徐晓洪名下的。其中两套是他和妻子分别从各自的父母那里继承来的，还有一套是自己建的，也就是和儿孙们一起住的这套，至今也有20多年。
此外，针对资溪县政府调查结果，老徐及其家人还提出三点质疑。
一、县政府做出暂缓建房决定的依据何在？能否公开会议记录？
二、组织国土、建设、城管、鹤城镇等单位拆房的法律依据是什么？为什么没有法院的意见和文字通知？
三、村民的上访不能作为执法的理由，更不是执法的依据。

而对于国土局执法大队大队长吴剑被调查一事，老徐表示，心里十分不安。因为建房审批，老徐经常要往国土局跑，因此没少与吴剑打交道。“吴剑只是一个没有选择余地的执行者，真正应该出面负责任的是拆房的决策者。”
